Provisions of Shanxi Province on Administration of Computer Security
(Promulgated and implemented as the order of the people's government of Shanxi Province No.82 on January 14, 1996, and amended pursuant to the order of the people's government of Shanxi Province No.218, Decision of the People's Government of Shanxi Province on Amending Part of the Regulation, promulgated on January 8, 2008.)
Article 1 In order to strengthen the administration on computer security, promote the application and development of computers, and ensure the smooth progress of socialist modernization construction, these Provisions are formulated in accordance with the Regulation of the People's Republic of China on the Security Protection of Computer Information System and combining the actual situation of this Province.
Article 2 These Provisions apply to any entity or individual that engages in research, teaching, operation and use of computers and computer system projects.
Article 3 The term "computer virus" as mentioned in these Provisions refers to a series of computer instructions or program codes, which are inserted into the computer procedure, that damage the function of computers or destroy data of computers, influence the use of computer and can self replicate.
Article 4 The provincial public security bureau shall take charge of the administration on computer security. The public security organs of all districts, cities and counties shall be responsible for the administration on computer security within their respective jurisdictions. The computer security supervision department of the public security organs at all levels shall be responsible for the implementation of these Provisions. Their main duties are:
1. To supervise, inspect and guide the work of computer security;
2. To notify about the infection condition of computer viruses, and provide technical service;
3. To handle the examination, registration and archival-filing of computer security administration;
4. To be responsible for the administration on the security of the computer information network of the province and the computer network of international networking;
