Chapter I General Provisions
Article 1 In order to standardize the supervision and inspection of statistics law enforcement, protect the legitimate rights and interests of citizens, legal persons and other organizations, and guarantee and improve the quality of statistical data, the Measures are formulated in accordance with the Statistics Law of the People's Republic of China, the Law of the People's Republic of China on Administrative Penalties, the Implementing Regulations of the Statistics Law of the People's Republic of China and other laws and administrative regulations.
Article 2 The Measures shall apply to the supervision and inspection of the implementation of statistics laws, regulations and rules by the statistics agencies of people's governments at or above the county level and the investigation and punishment of statistics violations.
Article 3 The Statistics Law Enforcement Supervision Department of the National Bureau of Statistics shall, under the leadership of the National Bureau of Statistics, be specifically responsible for organizing and managing the supervision and inspection of national statistics law enforcement, and guiding and supervising the statistics law enforcement supervision and inspection agencies of local statistics agencies and survey offices in their work, inspecting the implementation of the Statistics Law by various localities and departments, and investigating and dealing with major statistics violations.
Provincial and municipal statistics law enforcement supervision and inspection agencies shall, under the leadership of the statistics bureaus or survey offices to which they are affiliated, be responsible for guiding and supervising the supervision and inspection of statistics law enforcement in the regions or systems concerned, and inspecting the implementation of the Statistics Law by the regions or systems concerned and investigating and dealing with statistics violations. Statistics law enforcement supervision and inspection agencies or law enforcement inspectors at the county level shall, under the leadership of the statistics bureaus or survey offices to which they are affiliated, be responsible for the supervision and inspection of statistics law enforcement in the regions or systems concerned.
Local statistics agencies and survey offices shall establish a mechanism for communication and coordination in the supervision and inspection of statistics law enforcement.
Article 4 The relevant departments of people's governments at or above the county level shall, under the organization and guidance of the statistics agencies of the people's governments at the same level, be responsible for supervising the implementation of the Statistics Law by their departments in their statistical surveys, and transferring statistics violations occurring in their statistical surveys to the statistics agencies of the people's governments at the same level.
Article 5 The statistics agencies of the people's governments at all levels shall establish the responsibility system and accountability system for administrative law enforcement supervision and inspection, and effectively guarantee the personnel, funds and other working conditions required for the supervision and inspection of statistics law enforcement.
Article 6 The supervision and inspection of statistics law enforcement shall follow the principle of ensuring that laws are observed, law enforcement is strict, and violations are investigated, and adhere to the combination of prevention, investigation, treatment and rectification, to the combination of education and punishment, and to the principles of seeking truth from facts, being objective and fair, unified and standardized, efficient and disinterested, and civilized law enforcement.
In the supervision and inspection of statistics law enforcement, personnel who are interested in the objects under law enforcement supervision and inspection or may otherwise affect impartiality shall withdraw.
Article 7 The statistics agencies of people's governments at or above the county level shall unblock the channels for reporting statistics violations, publish the telephone numbers, correspondence addresses, network columns, and e-mails for reporting statistics violations, and diligently accept, verify, and handle reports of statistics violations.
Article 8 The statistics agencies of people's governments at or above the county level shall establish a system for reporting the investigation and punishment of statistics violations, and submit reports on statistics violations, the supervision and inspection of statistics law enforcement and the investigation and punishment of statistics violations to the statistics agencies at the higher level.
Chapter II Statistics Law Enforcement Supervision and Inspection Agencies and Law Enforcement Inspectors
Article 9 The statistics agencies of people's governments at or above the county level shall improve their the supervision and inspection of statistics law enforcement teams, improve their supervision and inspection of statistics law enforcement mechanisms, establish banks of backbone talents in statistics law enforcement, and ensure that the personnel in the banks obey the arrangement of the statistics agencies establishing the banks.
