Chapter I General Provisions

Article 1 These rules are formulated in accordance with the provisions of the Statistics Law of the People's Republic of China (hereinafter referred to as the Statistics Law).

Article 2 The term statistics as mentioned in the Statistics Law of the People's Republic of China refers to all activities of using various statistical methods for statistical investigations and statistical analyses on the development of the national economy and social development and for providing statistical data and consultant views and carrying out statistical supervisions.
The classification of all statistical items of the national economy and social development shall be stipulated and adjusted by the National Bureau of Statistics.

Article 3 The state shall, in a planned way, equip statistical agencies under the people's governments at all levels with modern information technology, and establish and perfect the state automatic system for statistical information. The various departments of the State Council may, in accordance with their needs, equip in a planned way the statistical agencies at the departments and their affiliated organizations with modern information technology.
The people's governments above the county level shall list the construction of the state statistics information projects into their development plans. The construction of the state statistics information projects shall be under the unified leadership of the National Bureau of Statistics, and the statistical agencies under the local people's governments above the county level shall be responsible for the projects at their respective levels.

Article 4 Statistical agencies and statistical personnel shall exercise responsibility systems and the systems for assessment, awards and penalties for their work so as to improve their work quality and working efficiency constantly.
Statistical agencies and statistical personnel shall exercise the following functions and power independently in accordance with law:
1. The power of statistical survey - investigating and collecting relevant information, holding relevant investigation meetings and checking
all kinds of original records and evidence concerning statistical data. The objects under statistical investigation shall provide truthful statistical data and information in accordance with the Statistics Law of the People's Republic of China and shall not make false entries, conceal statistical data, refuse to submit statistical data or report statistical data belatedly. Forging or tampering with statistical data shall be prohibited.
2. The power to make statistical reports - sorting out and analyzing the information and data obtained from statistical investigations and
submitting statistical reports to leading organs at higher levels and relevant departments. No units or individuals shall obstruct and withhold the statistical reports or tamper with statistical data.
3. The power of statistical supervision – in accordance with statistical investigation and statistical analysis, conducting statistical supervision of the national economy and social development, checking the implementation of national policies and plans, assessing economic results, social benefits and achievements, examining and exposing the existing problems, examining practices of making false entries, concealing, forging or tampering with statistical data and submitting proposals for work improvement. Relevant departments and units shall promptly deal with and reply to the problems reported or exposed and the proposals made by statistical agencies and personnel.

Article 5 Local people's governments above the county level, all departments, enterprises and institutions shall, in accordance with the state statistical tasks and the needs of their respective localities, departments and units, strengthen the leadership and supervision of statistical work in the following aspects:
1. Leading and supporting statistical agencies and personnel and other relevant personnel in implementing statistical laws, regulations and
systems, accurately and duly completing statistical tasks and strengthening modernization of statistical work;
2. Drawing and organizing statistical personnel to into the meetings on discussing relevant policies and plans and studying issues concerning economic and social development to give play to the role of service and supervision of statistics;
3. Organizing the implementation of major general investigations of national conditions and national strength in accordance with the unified plan of the state;
4. Examining and approving plans of statistical investigations in accordance with relevant provisions and providing the personnel and funds needed for the approved statistical investigations.

Article 6 The National Bureau of Statistics, the investigation teams sent by it and the statistical agencies under the local people's governments above the county level are the state organs implementing statistical laws, regulations and systems. They shall be responsible for supervising and inspecting the implementation of statistical laws, regulations and systems, upholding the functions and power of statistical agencies and personnel and fighting against the violations of statistical laws, regulations and systems.
The statistical agencies under the local people's governments above the country level shall fight against the violations of statistical laws and regulations in their respective administrative areas; any violation of statistical laws and regulations arising in a statistical investigation conducted by an investigation team sent by the National Bureau of Statistics shall be investigated by the investigation team organizing and conducting the statistical investigation.

Chapter II Statistical Investigation Plans and Statistical Systems

Article 7 The statistical agencies and competent departments under the people's governments above the county level shall establish separate statistical systems and draw up separate statistical investigation plans at the following three levels and shall implement the systems and plans after they have been approved by examination organs in accordance with relevant provisions:
1. National statistical investigations refer to the nationwide statistical investigations of basic conditions, covering
the investigations solely worked out by the National Bureau of Statistics and jointly worked out by the National Bureau of Statistics and relevant departments under the State Council. New and major investigations in national statistical investigation plans shall be submitted to the State Council for examination and approval by the National Bureau of Statistics. Regular and general investigations shall be examined and approved by the National Bureau of Statistics.
All localities, departments and units shall strictly conduct national statistical investigations in accordance with national statistical investigation plans.
