"The Decision of the State Council on the Revision of the Implementing Rules of the Statistics Law of the People's Republic of China" is now released and come into effect from February 1, 2006.

Annex: Decision of the State Council on the Revision of the Implementing Rules of the Statistics Law of the People's Republic of China

The State Council has decided to make the following revisions to the Implementing Rules of the Statistics Law of the People's Republic of China:

Article 1 The Article 6 is revised to read as: "The National Bureau of Statistics and its survey teams as well as the statistical agencies of the governments at and above county level are the state organizations to implement the statistical laws and regulations, responsible for supervising the implementation of the statistical laws and regulations, maintaining the functions of the statistical organizations and statistical practitioners, and serving as the law enforcers to deal with behaviors violating statistical laws and regulations."
A clause is added as Clause 2, which stipulates: "The statistical agencies of governments at and above county level are the state organizations to deal with illegal activities in statistical work occurred in their respective jurisdictions according to the related laws and regulations; illegal activities in statistical work organized and implemented by the survey teams sent out by the National Bureau of Statistics are to be handled and dealt with by the responsible survey teams."

Article 2The Article 21 is revised to read as: "The state should put into place a complete and healthy system for the monitoring and evaluation of the quality of statistical data, and strengthen the monitoring and evaluation of the important statistical data from various provinces, autonomous regions and municipalities."

Article 3The Article 22.(13) is revised to read as: "Under the leadership of the State Council, cooperate with related ministries to organize major general surveys of the national conditions and strength, and to organize and coordinate nationwide economic sampling surveys;" The Article 22.(17) is revised to read as: "Centrally lead and manage the survey teams sent out by the National Bureau of Statistics;"
A clause is added as Clause 2, which stipulates: "The survey teams sent out by the National Bureau of Statistics undertake various survey tasks assigned by the National Bureau of Statistics, independently conduct statistical surveys as permitted by law, and independently submit the statistical data."

Article 4The Article 23.(16) is deleted.

Article 5The Article 26.(12) is revised to read as: "Submit and provide statistical data in accordance with related state regulations, and perform statistical analyses and supervision to the implementation of related plans and performance of operational management in their own organizations;"

Article 6The Article 33.1 is revised to read as: "If enterprises or non-business organizations are found to have one of the following illegal behaviors as specified in The Article 27.1 of the Statistics Law of the People's Republic of China, the statistical agencies of governments at and above county level or the survey teams sent out by the National Bureau of Statistics can give them a warning, and can punish them with a fine below CNY50,000." The Article 33.2 is revised to read as: "If individual industrial and commercial entities are found to have one of the following illegal behaviors as specified in The Article 27.1 of the Statistics Law of the People's Republic of China, the statistical agencies of governments at and above county level or the survey teams sent out by the National Bureau of Statistics can give them a warning, and can punish them with a fine below CNY10,000."

This Decision will be implemented starting from February 1, 2006.
