The Decision of the NPC Standing Committee on Revising the Law of the PRC on Promotion of Cleaner Production, adopted at the 25th Session of the 11th NPC Standing Committee of the PRC on February 29, 2012, is hereby promulgated and shall become effective as of July 1, 2012.

Decision of the NPC Standing Committee on Revising the Law of the PRC on Promotion of Cleaner Production

It has been decided at the 25th Session of the 11th NPC Standing Committee to revise the Law of the PRC on Promotion of Cleaner Production ("Law")as follows:
I. The part that reads "incorporate cleaner production into national economic and social development plans" in Article 4 of the Law is revised to read "incorporate promotion of cleaner production (the "PCP") into national economic and social development schemes, and annual plans".
II. Article 5 of the Law is revised to read: "The general coordination department for cleaner production (the "GCDCP") under the State Council shall be in charge of organizing and coordinating the national PCP. The departments under the State Council in charge of environment protection, industry, science and technology, finance and other related fields shall, subject to their respective functions and responsibilities, deal with the PCP.
"The local people's governments at or above the county level (the "Local Governments") shall be in charge of directing the PCP under their respective administrative jurisdictions. The GCDCP appointed by the Local Governments shall be in charge of organizing and coordinating the PCP under their respective administrative jurisdictions. Other functional departments of the Local Governments shall be in charge of the required PCP subject to their respective functions and responsibilities."
III. Article 8 and 9 of the Law are combined and revised to become the new Article 8 that reads: "The GCDCP under the State Council shall, according to the national economic and social development plans, and the national requirements for saving resources, decreasing energy consumption and reducing discharges of key pollutants, prepare the national promoting schemes for cleaner production (the "PSCP"), together with the departments under the State Council in charge of environment protection, industry, science and technology, finance and other related fields, to be promptly published after the State Council approves such submitted promoting schedules.
"The national PSCP shall cover targets, main tasks and security measures in respect of cleaner production. For this purpose, it is required to define the key fields, industries and projects in the cleaner production according to energy consumption and pollution discharge.
"The competent departments under the State Council in charge of the concerned industries shall, according to the national PSCP, define their key projects in the cleaner production, formulate and organize to implement their special industrial PSCP.
"The Local Governments shall, according to the national PSCP and the relevant industrial PSCP, and based on their requirements for saving resources, decreasing energy consumption and reducing discharge of key pollutants, define the key projects in their cleaner production, formulate and organize to implement their implementing plans for promoting the cleaner production."
