Measures for the Administration of the Professional Qualification of Lightning Protection Engineering Projects

The Measures for the Administration of the Professional Qualification of Lightning Protection Engineering Projects are hereby promulgated, and shall come into force as of April 1st, 2005.

Chapter I General Provisions
Article 1 With a view to strengthening administration on the professional qualification of lightning protection engineering projects, regulating the acts of professional design and construction of lightning protection engineering projects, maintaining national interests and protecting the lives and properties of the people and public security, the present Measures are formulated in accordance with the Meteorology Law of the People's Republic of China and the Administrative Licensing Law of the People's Republic of China and other relevant provisions.
Article 2 Any entity that undertakes professional design or construction of lightning protection engineering projects within the territory of the People's Republic of
Article 3 The professional qualification of lightning protection engineering projects shall be divided into two categories of design qualification and construction qualification, the qualification grades shall be divided into three grades of grades A, B and C.
The competent meteorological organ of the State Council shall be responsible for the administration of professional qualifications of lightning protection engineering projects nationwide, and shall undertake the work for the determination of Grade A qualification of professional design and construction of lightning protection engineering projects. The competent meteorological organ of a province, autonomous region, or municipality directly under the Central Government shall be responsible for the administration of professional qualifications of lightning protection engineering projects within its own administrative region, and shall undertake the work for the determination of Grades B and C qualification of professional design and construction of lightning protection engineering projects.
Article 4 Entities with Grade A qualification may undertake the design or construction of lightning protection engineering projects, rectified projects and newly-added lightning protection engineering projects for lightning protection engineering constructions or structures of categories I, II and III as prescribed in the Design Code for Protection of Structures against Lightning and those in oil depots, gas storages, automobile gasoline and gas filling stations, liquefied natural gas, gas pipeline yards or sites, valve chambers and in other explosive dangerous environments.
Entities with Grade B qualification may undertake the design or construction of lightning protection engineering projects, rectified projects and newly-added lightning protection engineering projects and etc. for constructions or structures in categories II and III as prescribed in the Design Code for Protection of Structures against Lightning.
Entities with Grade C qualification may undertake the design or construction of lightning protection engineering projects, rectified projects and newly-added lightning protection engineering projects for lightning protection engineering constructions or structures of category III as prescribed in the Design Code for Protection of Structures against Lightning.
The design or construction of lightning protection engineering projects for cultural relic protection entities and other immovable cultural relics shall be undertaken by entities with Grade A or B qualification.
Article 5 The Certificate of Qualification for Professional Design of Lightning Protection Engineering Projects and the Certificate of Qualification for Professional Construction of Lightning Protection Engineering Projects shall have an original copy and a duplicate, and shall be printed by the competent meteorological organ of the State Council uniformly.
Article 6 The principle of openness, fairness, justness and people's convenience, high efficiency and trust protection shall be followed for the determination of the professional qualification of lightning protection engineering projects.
Article 7 Entities undertaking the production, sale and development of lightning protection engineering products shall not apply for the professional qualification of the design of lightning protection engineering projects.
Chapter II Conditions for Qualification Application
Article 8 Any entity applying for the professional qualification of design or construction of lightning protection engineering projects shall have the following basic conditions:
