The Measures for the Protection of the Historical and Cultural City of Beijing, which were adopted at the 19th meeting of the 12th Standing Committee of Beijing People's Congress on March 25, 2005 and shall come into effect as of May 1, 2005

Chapter I General Principles
 
Article 1 For the purpose of enhancing the protection of the historical and cultural city of Beijing and on the basis of the actual conditions of the Beijing Municipality, these measures are formulated in accordance with relevant laws and regulations on the national urban and rural planning as well as the protection of historical relics.
 
Article 2 The protection of the historical and cultural city of Beijing shall be governed by these Measures. If there are already laws and regulations on the protection of historical & cultural relics and ancient trees, such laws and regulations shall prevail.
 
Article 3 The protection of Beijing as key historical and cultural city shall follow the principles of "overall planning, unified management, emphasis on protection, and reasonable utilization".
 
Article 4 The Municipal People's Government of Beijing shall take overall charge of the protection of Beijing as a key historical and cultural city.
The local people's government of the districts and counties of the Beijing Municipality shall take charge of the specific measures for the protection of Beijing as a key historical and cultural city.
The municipal planning and administrative departments are responsible for the planning and management of the protection of the key historical and cultural city of Beijing.
The municipal administration for cultural relics shall perform the duties as stipulated in these Measures, take charge of the protection of architectures for which protection is necessary, participate in the formulation of plans for the protection of Beijing as a key historical and cultural city, the formulation of protection measures, and the identification of streets and areas of historical and cultural value.
The administrative departments of the Beijing Municipality in charge of development and reform, finance, construction, land resources, water resources, municipal management, parks and forest, tourism, and religious affairs as well as district- or county-level administrative departments in charge of historical relic protection shall perform their respective duties in the protection of Beijing as a key historical and cultural city.
 
Article 5 Beijing Municipality shall properly coordinate relationship between economic and social development on the one hand and the protection of the Beijing Municipality as a key historical and cultural city on the other hand, and incorporate such protection into the economic and social development plan and annual plan of the Beijing Municipality.
 
Article 6 The people's governments at the municipal, district, and county levels shall appropriate funds for the protection of Beijing as a key historical and cultural city in their respective fiscal budgets, and shall incorporate such fund into the execution of the government's investment management.
 
Article 7 The Beijing Municipality encourages entities and individuals to participate in the protection of Beijing as a key historical and cultural city via such means as donation, sponsorship, providing technical services, or submitting suggestions to the government.
The Beijing Municipality supports scientific researches, technical innovation, and the training of professionals related to the protection of Beijing as a key historical and cultural city.
 
Article 8 All entities and individuals of the Beijing Municipality shall be under the duty to protect Beijing as a key historical and cultural city, and shall have the right to submit suggestions concerning the formulation and execution of plans on such protection, and to dissuade anyone from destroying the key historical and cultural city of Beijing, and inform against such destruction.
 
Article 9 The people's governments at the municipal, district, and county levels shall commend and reward the entities and individuals that have made outstanding achievements in the protection of Beijing as a key historical and cultural city.

Chapter II Items under Protection
 
Article 10 The protection of Beijing as a key historical and cultural city shall cover the following items: the overall protection of the old city area, the protection of historical and cultural streets and neighborhoods, the protection of cultural relics on the protection list, the protection of valuable architectures worthy of such protection.
 
Article 11 For the purpose of these Measures, "old city area of Beijing" shall mean the area enclosed by the city moat that was dug in the Ming and Qing dynasties (including the city moat and ruins thereof).
