Administrative Measures for Work Safety Training

The Administrative Measures for Work Safety Training, which were adopted at the executive meeting of the State Administration of Work Safety (State Administration of Coal Mine Safety), are hereby promulgated, and shall come into force as of February 1st, 2005.

Administrative Measures for Work Safety Training

Chapter I General Provisions
 
Article 1 The present Measures are formulated in accordance with the Work Safety Law of the People's Republic of China and the relevant laws and administrative regulations for the purpose of strengthening administration on work safety training, regulating the order of work safety training, ensuring the quality of work safety training and promoting the healthy development of the work for work safety training.
 
Article 2 The present Measures shall be applicable to the safety training institutions and production and management entities for their undertaking of work safety training activities (hereinafter called by a joint name as the safety training), and to the administrative department of work safety supervision and the coal mine safety supervision organs for their supervision and administration of safety training work. In case the laws, administrative regulations and the State Council have different provisions, those provisions shall be followed.
 
Article 3 The "safety training" as mentioned in the present Measures shall refer to the activities of education and training aiming at improving the safety quality of safety supervision personnel, practicing personnel of production and management entities and the relevant personnel undertaking the work for work safety.
The safety supervision personnel as mentioned in the preceding paragraph shall refer to the work safety supervisors and coal mine safety supervisors who undertake safety supervision and inspection and administrative law enforcement in the administrative departments of work safety supervision of the people's governments at or above the county level and the coal mine safety supervision organs at all levels. The practicing personnel of any production and management entity shall refer to the main person in charge of the production and management entity, the work safety management personnel, the special operators and other practicing personnel thereof. The relevant personnel undertaking the work for work safety shall refer to the teachers undertaking the work for safety education and training, the registrars of dangerous chemicals and the personnel undertaking the safety appraisal, consultation, testing and inspection, as well as the registered safety engineers, etc..
 
Article 4 The principle of "unified planning, centralized management by specialized departments, graded implementation, classified guidance, separation of teaching and examination" shall be followed for the safety training work.
The State Administration of Work Safety (the State Administration of Coal Mine Safety) (hereinafter called by a joint name as the State Administration) shall guide the work for national safety training, and conduct supervision over and administration of safety training work of the whole country.
The administrative departments of work safety supervision of the provinces, autonomous regions and municipalities directly under the Central Government shall conduct supervision over and administration on the safety training work within their own administrative regions.
For the provinces, autonomous regions, and municipalities directly under the Central Government that have established coal mine safety supervision organs, the provincial coal mine safety supervision organs shall conduct supervision over and administration on the safety training work of the coal mine enterprises within their jurisdiction.

Chapter II Safety Training Institutions

Article 5 A safety training institution shall obtain the relevant qualification certificate when undertaking safety training activities. The qualification certificate shall have four grades.
Grade One and Grade Two qualification certificates shall be subject to the examination and approval of and issued by the State Administration. Grade Three and Grade Four qualification certificates shall be subject to the examination and approval of and issued by the administrative departments of work safety supervision of the provinces, autonomous regions, and municipalities directly under the Central Government. For the provinces, autonomous regions, and municipalities directly under the Central Government that have established coal mine safety supervision organs, the provincial coal mine safety supervision organs shall be responsible for the examination and approval and issuance of Grade Three and Grade Four qualification certificates for those training institutions undertaking coal mine safety training activities within their own jurisdictions.

Article 6 A safety training institution that has obtained Grade One qualification certificate may undertake the training of the work safety supervisor or coal mine safety supervisor of the administrative department of work safety supervision and coal mine safety supervision organs at or above the provincial level, the main person in charge and work safety management personnel of any production and management entity of the parent companies, factories or group corporations of enterprises under the Central Government, the registrar of dangerous chemicals, the personnel undertaking the work for safety appraisal, consultation, testing and inspection, the registered safety engineer and the teachers of any safety training institution below Grade One. A safety training institution that has obtained Grade Two qualification certificate may undertake the training of the work safety supervisor of the administrative departments of work safety supervision at the level of city or county, the main person in charge and work safety management personnel of any provincial production and management entity and the branch companies, subsidiaries of the enterprises under the Central Government and their subordinated entities, the registrar of dangerous chemicals, the personnel undertaking the work for safety appraisal, consultation, testing and inspection, and the registered safety engineer as well as the teachers of any safety training institution below Grade Two.
A safety training institution that has obtained Grade Three qualification certificate may undertake the training of special operators, the main person in charge of the production and management entities subject to a city or prefecture, and the work safety management personnel.
A safety training institution that has obtained Grade Four qualification certificate may undertake the training of practicing personnel of the production and management entities apart from those as prescribed in paragraphs one, two and three of this Article.
