Chapter I General Provisions
Article 1 These Regulations are formulated in accordance with the Postal Law of the People's Republic of China and other relevant laws to promote the healthy development of the express delivery industry, ensure the safety of express delivery, protect the legitimate rights and interests of express delivery users, and strengthen the supervision and regulation of the express delivery industry.
Article 2 These Regulations apply to the operation of express delivery businesses, the receipt of express delivery services, and the supervision and administration of the express delivery industry within the territory of the People's Republic of China.
Article 3 The development of the express delivery industry shall adhere to the principles of market orientation, safety assurance, innovation-driven development, and coordinated development. It shall aim to build an express delivery service system that is inclusive for urban and rural areas, technologically advanced, high-quality in service, safe, efficient, green, and energy saving.
Article 4 Local people's governments at all levels shall create a favorable business environment for the express delivery industry, support enterprises engaged in express delivery to innovate business models and service methods, and guide such enterprises to strengthen service quality management, improve internal rules and regulations, and enhance safety measures to provide fast, accurate, safe, and convenient express delivery services to users.
Local people's governments at all levels shall ensure that government actions comply with fair competition requirements and relevant laws and regulations, maintain the competitive order of the express delivery industry, and refrain from introducing policies that violate fair competition or may lead to regional blockades or industry monopolies.
Article 5 No entity or individual may use letters, parcels, printed materials, or other express delivery items (hereinafter collectively referred to as "express items") to engage in activities that endanger national security, public interests, or the legitimate rights and interests of others.
Except for inspections conducted by the relevant authorities in accordance with the law, no entity or individual may illegally inspect others' express items. No entity or individual may arbitrarily open, conceal, destroy, or resell others' express items.
Article 6 The postal administration department under the State Council is responsible for the supervision and administration of the express delivery industry nationwide. The public security, national security, customs, market supervision, and other relevant departments under the State Council are responsible for the related supervision and administration of express delivery within their respective duties.
Postal administration institutions in provinces, autonomous regions, municipalities directly under the central government, and postal administration institutions established below the provincial level as stipulated by the State Council are responsible for the supervision and administration of the express delivery industry in their respective jurisdictions. Relevant departments of local people's governments at or above the county level are responsible for the related supervision and administration of express delivery within their respective duties.
Article 7 The postal administration department under the State Council, as well as postal administration institutions in provinces, autonomous regions, municipalities directly under the central government, and below the provincial level (hereinafter collectively referred to as "postal administration departments"), shall cooperate with public security, national security, customs, market supervision, and other relevant departments to establish and improve express delivery safety supervision mechanisms, strengthen the monitoring and early warning of express delivery safety operations, collect and share information related to express delivery safety, and address incidents affecting the safe operation of the express delivery industry in accordance with the law.
Article 8 Legally established express delivery industry organizations shall protect the legitimate rights and interests of enterprises, strengthen industry self-regulation, promote lawful, honest, and safe operations by enterprises, urge enterprises to implement their primary responsibilities for production safety, and guide enterprises to continuously improve the quality and level of express delivery services.
Article 9 The State shall strengthen the construction of a credit system for the express delivery industry, establish and improve systems for credit records, information disclosure, and credit evaluation, implement joint disciplinary measures in accordance with the law, and enhance the credit level of the express delivery industry.
Article 10 The State shall improve comprehensive support policies to promote the greening, reduction, and recyclability of express delivery packaging.
The State encourages enterprises engaged in express delivery and senders to use biodegradable and reusable environmentally friendly packaging materials.
Chapter II Development Support
Article 11 The postal administration department under the State Council shall formulate development plans for the express delivery industry to promote its healthy development.
Local people's governments at or above the county level shall incorporate the development of the express delivery industry into their national economic and social development plans and consider the land use needs for large-scale express item collection, sorting, and other infrastructure in territorial spatial planning.
Local people's governments at or above the county level shall establish and improve policy measures to promote the healthy development of the express delivery industry, refine relevant supporting regulations, and protect the legitimate rights and interests of enterprises engaged in express delivery and their employees in accordance with the law.
Article 12 The State supports and encourages enterprises engaged in express delivery to develop express delivery service networks in rural and remote areas and improve the layout of express delivery endpoints.
Article 13 The State encourages and guides enterprises engaged in express delivery to adopt advanced technologies and promote the application of automated sorting equipment, mechanized loading and unloading equipment, intelligent endpoint service facilities, electronic express waybills, and express item information management systems.
Article 14 Public security, transportation, and other departments of local people's governments at or above the county level, together with postal administration departments, shall coordinate and cooperate to establish and improve mechanisms to ensure the passage and temporary parking rights of express delivery service vehicles, and shall not prohibit the lawful passage of express delivery service vehicles.
