Measures for the Dissolution of Illegal Social Organizations

Article 1 These Measures are formulated in accordance with the Administrative Regulations on the Registration of Social Groups, the Regulations on the Administration of Foundations, the Interim Administrative Regulations on the Registration of Private Non-Enterprise Entities, and other relevant provisions, to strengthen and regulate the investigation and handling of illegal social organizations, protect the lawful rights and interests of citizens, legal persons, and other organizations, and safeguard national security and social stability.

Article 2 These Measures shall apply to the dissolution of illegal social organizations by the registration and administration authorities for organizations (hereinafter the "registration authority").

Article 3 Any of the following organizations shall be considered as illegal social organizations:
(1) Those engaging in activities under the name of a social group, foundation, or private non-enterprise entity without registration;
(2) Those conducting activities beyond preparatory work during the preparation period of a social group; or
(3) Those continuing to engage in activities under the name of a social group, foundation, or private non-enterprise entity after their registration has been revoked or their registration certificates has been canceled.
The term "illegal social organizations" as mentioned in the preceding paragraph does not include community-based social organizations managed by subdistrict offices (or township governments) that do not meet registration requirements, nor does it include other organizations that are exempt from registration under the law.

Article 4 The county-level registration authority in the location where the illegal activities occur shall be responsible for the dissolution of the illegal social organization.
If the illegal activities involve the jurisdictions of two or more county-level registration authorities, their common higher-level registration authority shall be responsible for the dissolution, or it may designate a relevant lower-level authority to handle the dissolution.
For an illegal social organization engaged in activities across provinces (autonomous regions or municipalities directly under the Central Government), the Ministry of Civil Affairs under the State Council shall be responsible for the dissolution or may designate a relevant registration authority to handle the dissolution.

Article 5 If the higher-level registration authority deems it necessary, it may directly handle cases under the jurisdiction of the lower-level registration authority, or it may designate another lower-level registration authority to handle such cases.

Article 6 If an organization fails to obtain the necessary license or other approval documents as required by law and conducts activities without authorization, which should be investigated and punished by the relevant authority in accordance with laws and regulations, such matters shall be dealt with by the relevant authority and do not fall under the jurisdiction of the registration authority.

Article 7 Any organization or individual has the right to report illegal social organizations to the registration authority.
