Chapter I General Provisions
Article 1 These Measures are formulated in accordance with the Customs Law of the People's Republic of China, the Tariff Law of the People's Republic of China, the Law of the People's Republic of China on Entry and Exit Animal and Plant Quarantine, the Frontier Health and Quarantine Law of the People's Republic of China, and other relevant laws and administrative regulations, to regulate customs supervision of inbound and outbound baggage and articles, safeguard national security, and facilitate customs clearance at ports.
Article 2 These Measures shall apply to customs supervision over inbound and outbound baggage and articles.
Article 3 Inbound and outbound baggage and articles shall enter or exit through locations with established customs offices for entry or exit.
In special circumstances, if inbound and outbound baggage and articles need to temporarily enter or exit through locations without customs offices, customs formalities shall be handled in accordance with the provisions of these Measures, upon approval by the State Council or by agencies authorized by the State Council.
Article 4 Inbound and outbound individuals may handle customs formalities for their baggage and articles personally or entrust others to do so.
Article 5 Inbound and outbound baggage and articles shall meet the requirements for reasonable personal use; and those exceeding the quantity deemed reasonable for personal use shall be subject to customs procedures for goods.
Article 6 Baggage and articles carried by inbound and outbound individuals for entry or exit shall comply with the provisions of laws, administrative regulations, and regulations of the State Council or regulations issued by relevant departments under the State Council based on the authorization of laws or administrative regulations.
Inbound and outbound individuals shall not carry baggage and articles that contravene national prohibitive regulations on entry or exit.
Inbound and outbound individuals carrying baggage and articles subject to national restrictive regulations for entry or exit, shall comply with the limits and quantity restrictions, and submit relevant permits, certificates, and other supporting documents in accordance with the law.
Article 7 Customs shall strengthen the application of modern sci-tech innovations to enhance the informatization, digitalization, intelligence, standardization, and facilitation of supervision of inbound and outbound baggage and articles.
Chapter II Declaration
Article 8 Inbound and outbound individuals carrying baggage and articles for entry or exit shall make truthful declarations to Customs.
Customs shall accept written declarations from inbound and outbound individuals at declaration locations, such as declaration counters.
Article 9 Inbound individuals shall make written declarations to Customs in any of the following circumstances:
(1) Carrying prohibited articles for entry;
(2) Carrying restricted articles for entry that exceed the specified limits or quantity requirements, or for which permits, certificates, and other supporting documents are required;
(3) Carrying animals, plants, animal and plant products, and other quarantine items;
(4) Carrying blood, human tissues, pathogenic microorganisms, biological products, and other items related to public health safety;
(5) Carrying articles contaminated by, or posing a risk of spreading, quarantinable infectious diseases;
(6) Carrying currency in cash that exceeds the prescribed amount;
(7) Carrying articles in excess of the prescribed duty-free allowance or quantity restrictions;
(8) Carrying goods, samples, or advertising materials;
(9) Transporting baggage and articles separately; or
(10) Carrying other baggage and articles that require written declaration in accordance with the law.
Article 10 Outbound individuals shall make written declarations to Customs in any of the following circumstances:
(1) Carrying prohibited articles for exit;
(2) Carrying restricted articles for exit that exceed the specified limits or quantity requirements, or for which permits, certificates, and other supporting documents are required;
(3) Carrying goods, samples, or advertising materials;
(4) Carrying blood, human tissues, pathogenic microorganisms, biological products, and other items related to public health safety;
(5) Carrying articles contaminated by, or posing a risk of spreading, quarantinable infectious diseases;
(6) Carrying currency in cash that exceeds the prescribed amount; or
(7) Carrying other baggage and articles that require written declaration in accordance with the law.
Article 11 When making written declarations to Customs, inbound and outbound individuals shall fill out a paper declaration form or provide electronic declaration data.
Inbound and outbound individuals shall present their valid entry/exit documents to Customs at designated locations, such as declaration counters, submit paper declaration form or confirm the electronic declaration data, provide permits, certificates and other supporting documents, and undergo Customs inspection.
If the circumstances listed in Article 9 or Article 10 apply, and the written declaration procedure is not completed as specified before Customs conducts inspection measures, it will be regarded as a failure to declare to Customs.
Article 12 When passing through locations where the customs authority implements a Red and Green Channel declaration mode, inbound and outbound individuals carrying baggage and articles who are required to make written declarations to Customs in accordance with these Measures, or who are unclear about customs regulations or do not know how to select a channel, shall choose the Red Channel.
