Chapter I General Provisions
Article 1 These Measures are formulated in accordance with the Customs Law of the People's Republic of China and other pertaining laws and administrative regulations in order to strengthen the customs' supervision over and facilitate the customs clearance of the inward and outward express consignments.
Article 2 For the purpose of these Measures, the term "inward and outward express consignments" refers to inward and outward goods and articles undertaken or carried by the operator of inward and outward express consignments by means of the rapid commercial operations they promise to their customers.
Article 3 For the purpose of these Measures, the term "operator of inward and outward express consignments" (hereinafter referred to as "operator") refers to the international freight agency engaging in the inward and outward express consignments operation who has registered by law within the PRC and has registered and recorded with the customs.
Article 4 Any operator may not undertake or carry any article listed in the Form of the People's Republic of China on the Articles Prohibited from Entering or Exiting the Territory, and shall not discretionally deal with any of such articles but shall forthwith report it to the customs and cooperate with the customs in dealing therewith.
Any operator shall not undertake or carry any private letter without the approval of the postal institution of the People's Republic of China.
Article 5 No operator shall lease, lend or transfer its right to customs declaration for the inward and outward express consignments or make declaration for goods or articles not undertaken or carried by itself on behalf of any other person.
Article 6 Without approval of the customs, no inward and outward express consignment, for which the customs formalities has not been completed, may be moved out of the customs supervision areas or be loaded, unloaded, opened, re-packed, marked with a sign different from the original one, drawn, dispatched, or delivered for transport.
Chapter II Registration of the Operator
Article 7 Any operator who applies for making customs declarations on behalf of any other person for inward and outward express consignments shall complete the record-filing with the local customs.
Article 8 Any operator shall, when registering with the local customs, meet the following conditions:
1. Having obtained the Record-filing Form of International Freight Agency Enterprises handled by the foreign trade authority of the state council and the record-filing entity entrusted by it, except otherwise stipulated by laws;
