Chapter I General Provisions
Article 1 These Measures are formulated in accordance with the Customs Law of the People's Republic of China, and other relevant laws and administrative regulations in order to regulate the administration of the inward and outward of articles for official use of resident offices.
Article 2 The inward and outward articles for official use by a resident office, shall be restricted, within a reasonable amount, for self-use.
A resident office or the declaration enterprise entrusted by it may undergo customs clearance formalities for the entry and exit of articles for official use at the customs in charge or the customs of the relevant port. A resident office shall undergo customs clearance formalities at the customs in charge of the entry and exit of vehicles for official use.
When articles for public use are subject to customs clearance, the customs may check the relevant articles to prevent the entry and exit of prohibited articles.
After the release of articles for official use, the customs may conduct spot checks of the use of such articles by conducting on-site verification or otherwise.
Article 3 Customs shall collect taxes on the inward and outward of articles for official use of a resident office, in accordance with relevant provisions of the Tariff Law of the People's Republic of China.
Taxes shall be exempted on tax-free articles for official use imported by a resident office, when provided for in a convention that has been concluded between the governments.
Chapter II Supervision over Entry of Articles for Official Use
Article 4 In the event a resident office declares the entry of articles for official use for the first time, it shall complete formalities for archiving to the customs house in charge, upon the strength of the following documents:
1. The photocopies of, documents of approval of the examination and approval authority for establishing the resident office;
2. The photocopy of, registration certificate (hereinafter referred to as the Registration Certificate) issued by the competent department;
3. Pattern of declaration seal of the resident office;
4. The photocopies, of the pattern of signature and identity certificate of the responsible person of the resident office; and
5. Name list of the resident staff members of the resident office, which shall cover the names, genders and nationalities of the resident staff members, the number of the effective entry/exit certificate, number of the permanent residence certificate, tenure, position and the address within the territory of China.
After the competent customs house in charge has examined and confirmed there is no mistake in the documents, it shall issue a Certificate of Archival Filing of Resident Offices of the Customs of the People's Republic of China (hereinafter referred to as the Customs Archival Filing Certificate).
