Chapter I General Provisions
Article 1 This Law is enacted to ensure scientific and effective organization of statistical work, safeguard the authenticity, accuracy, completeness and timeliness of statistical data, strengthen statistical supervision, leverage the vital role of statistics in understanding the national conditions and strength and serving high-quality economic and social development, and promote the comprehensive building of a modern socialist country.
Article 2 This Law shall apply to statistical activities organized and conducted by people's governments at all levels, statistical agencies and relevant departments of people's governments at or above the county level.
The basic tasks of statistics are to conduct statistical surveys and analyses on economic and social development, provide statistical data and statistical advisory opinions, and exercise statistical supervision.
Article 3 The leadership of the Communist Party of China shall be upheld in statistical work.
The State shall establish a centralized and unified statistical system and implement a statistical management system featuring unified leadership and hierarchical responsibility.
Article 4 The State Council and local people's governments at all levels as well as relevant departments shall strengthen the organization and leadership of statistical work and provide necessary guarantees for statistical work.
Article 5 The State shall strengthen statistical research, improve scientific and reasonable statistical standards and statistical indicator systems in line with new situations in economic and social development, incorporate new economic sectors and emerging fields into the scope of statistical surveys, and continuously improve statistical survey methods to enhance the scientific nature of statistics.
The State shall systematically strengthen the development of statistical information technology, promote in-depth integration of modern information technology and statistical work, and facilitate the modernization of technologies for statistical information collection, processing, transmission, sharing, storage and statistical database systems.
Article 6 The State shall establish a complete, efficient, well-constrained and authoritative statistical supervision system.
Statistical agencies shall, as per statistical survey systems and approved plans, conduct statistical supervision on the implementation of major national economic and social policies and measures in various regions and departments as well as the performance of statutory statistical duties.
Article 7 Statistical agencies and statisticians shall independently exercise their functions and duties of statistical surveys, statistical reporting and statistical supervision in accordance with the provisions of this Law, and their rights shall not be infringed upon.
Leading officials of local people's governments at all levels, statistical agencies and relevant departments of people's governments at or above the county level, as well as the entities concerned, shall not unilaterally alter statistical data that has been lawfully collected and compiled by statistical agencies and statisticians. They shall not, in any way, require statistical agencies, statisticians or other agencies and individuals to fabricate or tamper with statistical data, nor shall they explicitly or implicitly instruct subordinate entities and their staff or statistical survey subjects to submit false statistical data. Retaliation against entities and individuals that lawfully perform their duties or refuse and resist illegal statistical acts is strictly prohibited.
Article 8 State authorities, enterprises, public institutions and other organizations, as well as individual businesses and individuals, as subjects of statistical surveys, shall provide authentic, accurate, complete and timely statistical data as required for statistical surveys in accordance with this Law and relevant national regulations, and shall not provide false or incomplete statistical data, nor shall they delay or refuse to submit statistical data.
Article 9 Local people's governments at all levels, statistical agencies and relevant departments of people's governments at or above the county level shall incorporate the prevention and punishment of statistical falsification and fraud into the scope of their responsibilities for law-based administration and duty performance, establish and improve relevant accountability systems, strengthen the assessment and management of statistical work for leading officials, and hold those liable for statistical falsification and fraud accountable in accordance with the law.
Article 10 Statistical work shall be subject to public supervision. Any entity or individual has the right to report illegal acts such as statistical fraud. Entities and individuals that have made outstanding contributions in reporting such acts shall be commended and rewarded.
Article 11 Statistical agencies and statisticians shall maintain the confidentiality of state secrets, work secrets, trade secrets, personal privacy and personal information they come to know in statistical work, and shall not disclose or illegally provide them to others.
Article 12 No entity or individual shall obtain honorary titles, material benefits, promotions in positions or ranks by using false statistical data.
Chapter II Management of Statistical Surveys
Article 13 Statistical survey projects include national statistical survey projects, departmental statistical survey projects and local statistical survey projects.
National statistical survey projects refer to statistical surveys of basic nationwide information.
