Organic Law of the State Council of the People's Republic of China (Revised in 2024)
Order No. 21 of the President of the People's Republic of China

The Organic Law of the State Council of the People's Republic of China, as revised and adopted at the 2nd Session of the 14th National People's Congress of the People's Republic of China on March 11, 2024, is hereby promulgated, and shall come into force on the date of promulgation.

(Adopted at the 5th Session of the 5th National People's Congress on December 10, 1982 and promulgated and took effect on the same day, and revised at the 2nd Session of the 14th National People's Congress on March 11, 2024)
Article 1 This Law is enacted in accordance with the Constitution for the purposes of improving the organization and working system of the State Council, and safeguarding and regulating the State Council's exercise of functions and powers.
Article 2 The State Council of the People's Republic of China, that is, the Central People's Government, is the executive organ of the highest organ of state power and the highest state administrative organ.
Article 3 The State Council shall adhere to the leadership of the Communist Party of China (“CPC”), follow the guidance of Marxism-Leninism, Mao Zedong Thought, Deng Xiaoping Theory, the Theory of Three Represents, the Scientific Outlook on Development, and Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, resolutely uphold the authority and the centralized and unified leadership of the CPC Central Committee, steadfastly implement the decisions and arrangements made by the CPC Central Committee, carry out new development philosophy, exercise law-based administration, and fully and correctly perform government functions in accordance with the Constitution and laws.
The State Council shall adhere to a people-centered approach and serve the people wholeheartedly, adhere to and develop whole-process people's democracy, always maintain close contact with the people, listen to the opinions and recommendations of the people, and build a law-based, innovative, clean, and service-oriented government to the satisfaction of the people.
Article 4 The State Council shall be responsible to and report work to the National People's Congress or, when the National People's Congress is not in session, to its Standing Committee.
The State Council shall conscientiously accept supervision by the National People's Congress and its Standing Committee.
Article 5 The State Council shall be composed of the Premier, Vice-Premiers, State Councilors, ministers of all ministries, directors of all commissions, Governor of the People's Bank of China, Auditor-General, and Secretary-General.
The Premier shall assume overall responsibility for the work of the State Council.
