(Adopted at the 37th Meeting of the Standing Committee of the 9th People's Congress of Guangdong Province on October 13, 2002, and amended in accordance with the Decision on Amending the Regulations of Guangdong Province on Safety Production of the 27th Meeting of the Standing Committee of the People's Congress of Guangdong Province on September 28, 2006)
Chapter I General Provisions
Article 1 These Regulations are formulated for the purposes of intensifying safety production, preventing and reducing accidents, safeguarding personal and property safety, and facilitating economic development and social stability and in accordance with the Work Safety Law of the People's Republic of China and other relevant laws and regulations by taking the actual situation of this province into account.
Article 2 These Regulations shall be applicable to safety production of entities engaging in production and operation activities (hereinafter referred to as the "production and operation entities") within the administrative region of this province.
Where relevant laws or administrative regulations have other provisions, such provisions shall be observed.
Article 3 In safety production the principles of safety first and prevention crucial shall be adhered to, and the responsibility system of safety production shall be established and completed.
Article 4 Major responsible persons of people's governments at all levels and other relevant departments are the chief responsible persons of safety production, and shall take full responsibilities for safety production of their respective districts or departments; persons in charge of safety production are the persons directly responsible for safety production, and shall take direct leadership responsibilities for safety production; other responsible persons shall take direct leadership responsibilities for safety production within their respective business scopes.
Article 5 Regulatory authorities of safety production of people's governments at all levels (hereinafter referred to as the "regulatory authorities of safety production") shall comprehensively administrate the safety production within their respective administrative regions, exercise their functions and powers of safety production, and be in responsible for organizing the implementation of these Regulations.
Relevant departments of the people's governments at all levels shall, according to applicable laws and regulations, supervise and administrate the implementation of production safety within their respective terms of reference.
Trade unions at all levels shall secure lawful rights and interests of practitioners in safety production in accordance with applicable laws, and supervise the implementation of laws and regulations on safety production by production and operation entities.
Article 6 People's governments at all levels shall carry out regular publicity and education on safety production and enhance citizens' awareness of safety production.
New media such as broadcast, television and newspaper have the obligation to carry out publicity and education on safety production.
Article 7 People's governments or relevant departments shall commend and reward entities and individuals that have made outstanding achievements in improvement of safety production conditions, prevention of safety production accidents, and participation in rescues and relieves.
Chapter II Responsibilities and Guarantees for Safety Production
Article 8 Legal representatives or major operation managers of production and operation entities shall take full responsibilities in safety production of their respective entities; responsible persons in charge of safety production are the persons directly responsible for safety production, and shall take direct leadership responsibilities for safety production; other responsible persons shall take leadership responsibilities for the safety production within their respective business scopes.
Article 9 Production and operation entities shall have the conditions for safety production as stipulated in applicable laws, administrative regulations and national standards or industrial standards; or otherwise, such entities may not engage in production and operation activities.
Article 10 No production and operation entity may contract or lease any project, workplace or equipment of production and operation to any other entity without conditions for safe production or any individual without corresponding qualifications.
A production and operation entity shall enter into dedicated agreement on safety production management with the contractor or lessee or specify their respective responsibilities for safety production management in the contracting agreement or leasing contract; the production and operation entity shall coordinate and manage the safety production of the contractor or lessee in a unified manner.
Article 11 The major responsible persons and managers of safety production of production, operation and storage entities of hazardous objects and mines and building construction entities shall not take their positions until they have passed the examinations held by relevant competent departments concerning their knowledge on safety production and management capacity.
