Administrative Provisions on the Construction Engineering Survey and Design Qualification

To the people's governments of all provinces, autonomous regions and municipalities directly under the Central Government, all ministries and commissions of the State Council and all institutions under the direct administration of the State Council:

As China's reform and opening-up deepens and the socialist market economic mechanism improves, the circulation industry is playing an increasingly prominent role in such aspects as promoting production, guiding consumption, facilitating the adjustment of economic structure and economic growth mode. At present, the overall layout of supply and demand in China's commodity market has undergone a fundamental change and the international competition we face is becoming more intense. However, there still exist such problems in the circulation field as comparatively small scale, low degree of organization, inadequate modernization and unsound market mechanism with respect to circulation enterprises, which imperatively requires us to adopt and implement the scientific development outlook, build a large market, develop large-scale trade, vitalize large circulation, accelerate the integration of domestic and overseas trade and of trade, industry and agriculture sectors, and promote the adjustment of the economic structure and the transformation of economic growth mode so as to contribute to the promotion of the coordinated development of urban and rural areas and the sound, fast and sustainable development of the national economy. For such a purpose, relevant opinions are hereby set out as follows:

Article 1 Intensify reform and enhance the competitive power of circulation enterprises
1.More efforts should be made to promote the reorganization and transformation of state-owned circulation enterprises. The reform of state-owned circulation enterprises should be deepened and a modern enterprise system should be established The people's governments at all levels should , in light of their local situations, adopt a variety of measures to support the reorganization and transformation of state-owned circulation enterprises, increase their vitality and enhance their profit-making capability. For any state-owned circulation enterprise which is insolvent, has been at a loss for a long time or has no hope of changing the loss-making situation, any such enterprise should by disposed by way of lease, sale, debt reorganization, and close-down and bankruptcy, etc. in accordance with law; enterprises should be supported in carrying out inter-industrial, inter-regional and trans-ownership asset reorganizations and all kinds of capital should be encouraged to participate in the reorganization and reform of circulation enterprises. In the process of deepening the reform of circulation enterprises, attention should be paid to the preservation of the credit assets of banks so as to prevent bank debts from being evaded or abandoned.
2. The historical burdens of state-owned circulation enterprises should handled in a proper manner. After gonging through transfer formalities and paying land transfer fees, a state-owned circulation enterprise is allowed to incorporate land allocated to and used by them into the total assets of the enterprise to offset its debts. State-owned enterprises may, upon the approval of the administrative departments of public finance and state-owned assets, set off their historic debts by selling the state-owned property rights held by them in accordance with the relevant provisions of the State.
3. The placement of employees should be conducted in an appropriate manner and the cost for the reform of state-owned enterprises should be lowered. State-owned circulation enterprises are entitled to policies specified in the Implementation Measures for the Dismissal and Placement of Surplus Employees as a Result of the Separation of Main Business from Auxiliary Business and the Reform of Auxiliary Business by Large and Medium State-owned Enterprises (Guo Jing Mao Qi Gai[2002] No. 859) issued by eight departments including the former State Economic and Trade Commission. Income derived from the sale of self-owned business or offices by circulation enterprise in accordance with the law and income derived from the disposal of allocated land used by the enterprise may be used first by the enterprise for the payment of social insurance and for the placement of employees. For the assets of state-owned medium- and small-sized circulation enterprises that are sold to the management or employees of enterprises, the procedures for "bidding, auction and affiliation" should be standardized and should not be carried out until the procedures for decision-making, asset examination, financial auditing and asset appraisal and verification have been gone through.
