The Provisions of Beijing Municipality on Encouraging the Establishment of Scientific and Technological Research and Development Institutions in Beijing Municipality are hereby printed and issued to you for your faithful implementation.

Appendix: Provisions of Beijing Municipality on Encouraging the Establishment of Scientific and Technological Research and Development Institutions in Beijing Municipality

Article 1 These Provisions are formulated in order to exert the capital's advantages of centralized talents and abundant scientific and educational resources, promote the advancement of science and technology, strengthen the regional innovation capacity, accelerate the development of knowledge-based service industry and enhance the capital's economic quality and benefits.

Article 2 These Provisions shall apply to the scientific and technological research and development institutions (hereinafter referred to as "R&D Institutions") established by foreign or domestic organizations or individuals and certified in the administrative area of Beijing Municipality.

Article 3 Beijing Municipal Science & Technology Commission shall be responsible for certifying the R&D Institutions, issue the Certificate of Beijing Municipal Scientific and Technological R&D Institution and reexamine the certified R&D Institutions once every two years.

Article 4 The domestic organizations or individuals that intend to establish R&D Institutions in Beijing Municipality to undertake operation activities shall register at the competent authorities of industry and commerce and acquire the Corporate Business License or Business License in accordance with the law.
A R&D Institution may be established as a branch institution of an enterprise.

Article 5 The organizations or individuals from foreign countries, Hong Kong Special Administrative Region, Macao Special Administrative Region and Taiwan Region that intend to establish R&D Institutions shall transact the procedures of examination and approval and registration pursuant to relevant regulations.

Article 6 The following conditions shall be satisfied in case of establishing R&D Institutions in Beijing Municipality:
1. The R&D Institution shall undertake the fundamental research, application research, high-tech research, scientific research for public welfare, technology development and experiments in the natural science-related fields.
2. It shall be clearly directed in the research and development, complies with the national and local technical and industrial policies, and possesses fixed premises, instrument and equipment and other necessary scientific research conditions. The buildings for scientific research shall cover an area of not less than 200 square meters and the total assets shall amount to not less than CNY5,000,000 (the total assets of software-based R&D Institution shall amount to not less than CNY1,000,000).
