The Interpretation of the Supreme People's Court on Several Issues Concerning the Application of Law in Hearing Criminal Cases of Destructing Land Resources, which was adopted at the 1119th meeting of the Judicial Committee of the Supreme People's Court on June 16, 2000, is hereby promulgated and shall come into force as of June 22, 2000.
Appendix: Interpretation of the Supreme People's Court on Several Issues Concerning the Application of Law in Hearing Criminal Cases of Destructing Land Resources

For the purpose of punishing the criminal activities of destructing land resources in accordance with the law, and, we, in accordance with relevant provisions of the Criminal Law, hereby interpret the relevant issues concerning the specific application of the law in such criminal cases as follows:
Article 1 Where anyone, in violation of relevant regulations on land administration, illegally transfers or scalps the land use right for the purpose of making profits under any of the following circumstances, the case shall be deemed as the "serious circumstances" of the illegal transfer or scalping of land use right, and the violator shall be punished under the crime of illegal transfer or scalping of land use right in accordance with the provisions of Article 228 of the Criminal Law:
1. More than five mu of basic farmland has been illegally transferred or scalped by the violator;
