Chapter I General Provisions
Article 1 These Regulations are formulated to enhance the management of survey and design activities for construction projects, ensure the survey and design quality of construction projects, and safeguard the safety of people's lives and property.
Article 2 Anyone engaged in survey and design activities for construction projects must comply with these Regulations.
The term "survey of construction projects" as mentioned herein refers to the activities of investigating, analyzing, and evaluating the geological and geographical environment characteristics as well as geotechnical engineering conditions of construction sites, and preparing construction project survey documents according to the requirements of construction projects.
The term "design of construction projects" as mentioned herein refers to the activities of conducting comprehensive analysis and demonstration of the technical, economic, resource, environmental and other conditions required for construction projects and preparing construction project design documents according to the requirements of construction projects.
Article 3 The survey and design of construction projects shall align with the current level of social and economic development, and strive to achieve a harmonious balance between economic, social, and environmental benefits.
Article 4 Construction project survey and design activities shall follow the principle of survey first, design second, and construction third.
Article 5 The administrative departments for construction of the people's governments at or above the county level and the competent departments for transport and water conservancy shall strengthen the supervision and administration of survey and design activities for construction projects in accordance with these Regulations.
Survey and design entities for construction projects shall conduct construction project survey and design in accordance with the law, strictly implement mandatory standards for project construction, and be responsible for ensuring the quality of construction project survey and design.
Article 6 The State encourages the adoption of advanced technology, advanced process, advanced equipment, new materials and modern management methods in survey and design activities for construction projects.
Chapter II Qualification Management
Article 7 The State shall implement a qualification management system for entities engaged in survey and design activities for construction projects. The specific measures in this regard shall be formulated by the administrative department for construction of the State Council in consultation with relevant departments of the State Council.
Article 8 A survey or design entity for construction projects shall undertake the survey and design business for construction projects within the scope permitted by its qualification level.
A survey or design entity for construction projects shall be prohibited from undertaking any survey and design business for construction projects outside the scope permitted by its qualification level or undertaking such business in the name of any other survey or design entity. A survey or design entity for construction projects shall not permit any other entities or individuals to undertake survey and design business for construction projects in its name.
Article 9 The State shall implement a practice qualification registration management system for professional and technical personnel engaged in survey and design activities for construction projects.
Any unregistered survey or design personnel for construction projects shall not engage in survey and design activities for construction projects in the name of registered practitioners.
Article 10 A registered practitioner or any other professional and technical person engaged in survey and design activities for construction projects may only be employed by one survey or design entity for construction projects.
