Chapter I General Provisions

Article 1 For the purposes of regulating the management of Customs to Pingtan Comprehensive Experimental Zone (hereinafter referred to as Pingtan), these Measures are constituted according to Customs Law of the People's Republic of China and other related laws, administration regulations.

Article 2 These Measures apply to the supervision and inspection of Customs to the means of transportation, goods, articles exiting or entering boundary via Pingtan, or exiting and entering Pingtan, and the enterprises and places that have completed the record-filing with Customs in Pingtan.

Article 3 The entry port between Pingtan and overseas is set as "first-tier" administration: The pass connecting with Pingtan and any other areas within the customs territory of the People's Republic of China (hereinafter referred to as the "Outer Area") is set as "second-tier" administration. The customs implement hierarchical management according to the principle of "easing regulation by the first-tier customs offices, maintaining the regulation by the second-tier customs offices, separating personnel from commodities and applying differentiated management".

Article 4 Pingtan shall set up patrolling around the island, monitoring facilities which meet the requirements of Customs supervision, and Customs information management platform "first-tier", "second-tier" customs supervision area and the customs supervision places in Pingtan shall set up the facilities, equipment, areas meeting the requirements of Customs supervision. Pingtan may not launch its related business until the General Administration of Customs inspects to be qualified.

Article 5 Related enterprises and units, dealing with import and export business with sharing the policies of being in bond, tax reliefs and tax reimbursement after entering the zone and related storage, distribution and enterprises and units (hereinafter referred to as "enterprises") dealing with customs clearance business, shall complete the record-filing procedure with the Customs.
Enterprises shall set up the account book, report forms meeting the requirements of customs supervision, and accept the customs inspection.
The enterprises shall establish a computer management system meeting the supervisory requirements of customs and connect the said database with the computers of the Customs in order to exchange their electronic data.

Article 6 Where the bonded goods and tax-free goods related with production exiting or entering into Pingtan and stored in Pingtan and the goods sharing policy of tax reimbursement after entering the zone from outer areas to Pingtan (hereinafter referred to as "tax-free goods"), unless otherwise provided for by laws, administration regulations and rules, is implemented on the management of electronic account book by the Customs.

Article 7 The Customs implements supervision to the trade market of Taiwan commodity set up in Pingtan, the detailed regulations are constituted separately by the General Administration of Customs.

Article 8 The cargos and articles prohibited by the laws, administration regulations and rules, shall not enter the "first-tier" of Pingtan, The cargos prohibited by the laws, administration regulations and rules, shall not enter Pingtan from "second-tier" by the way of customs clearance.
The enterprises in Pingtan shall not develop the processing trade business for the merchandise listed in the Catalogue of Prohibited Commodities in Processing Trade.

Chapter II Supervision on the goods exited and entered between Pingtan and overseas.

Article 9 The Customs implements the administration of registration to the bonded goods, tax-free goods and tax-reimbursed goods related with production exited and entered between Pingtan and overseas, and deals with formalities of customs clearance for the other goods exited and entered between Pingtan and overseas according to related provisions of imported and exported goods, unless otherwise provided for by laws, administration regulations and rules.

Article 10 Where the goods related to production entered from overseas to Pingtan is implemented in the administration of being in bond or tax-free, except the following goods:
