Chapter I General provisions
Article 1 For the purpose of normalizing the administration on Hengqin New Area (hereinafter referred to as the "Hengqin"), these Measures are formulated in accordance with the Customs Law of the People's Republic of China, other relevant laws and regulations.
Article 2 These Measures are applicable to the Customs' supervision, administration and inspection on transportation means, cargos, articles entering and leaving Hengqin and enterprises and locations that have completed record-filing with the Customs within Hengqin.
Article 3 The port of entry between Hengqin and Macau is set to be under "first class" administration; ports between Hengqin and other regions of the PRC (hereinafter referred to as the "regions outside Hengqin") are set to be under "second class" administration. The Customs shall conduct administration on such port based on different classes pursuant to the principle of "relax restrictions in first class, control in second class, separate persons and cargos and exert sort management".
Article 4 Hengqin shall establish patrol around the island, monitoring facility and customs information management platform in compliance with the customs supervisory requirements; facilities, equipments, locations and so forth shall be established in "first class" and "second class" customs supervision zones and in Hengqin customs supervision places in compliance with the customs supervisory requirements. Hengqin may engage in relevant business upon check and acceptance by the General Administration of Customs.
Article 5 Enterprises and entities engaged in imports and exports which enjoy policies of bond, tax reliefs and tax refund upon entry and engaged in relevant warehouse logistics and customs declaration (hereinafter referred to as the "enterprises") shall go through record-filing formalities with the Customs.
Enterprises shall set up account books, report forms etc. in compliance with the Customs supervisory requirements according to law and accept inspection of the Customs.
Enterprises shall establish computer management systems in compliance with the Customs supervisory requirements so as to realize networking connection and exchange E-data with the Customs.
Article 6 The Customs shall, except otherwise regulated by laws, administrative regulations and rules, conduct E-account book administration on cargos entering and leaving Hengqin, cargos in bond which are stored in Hengqin, tax exempted cargos in relation to production and cargos from regions outside Hengqin which enjoy policy of tax refund upon entry (hereinafter referred to as the "cargos of tax refund").
Article 7 Cargos and articles which are prohibited from entry by laws, administrative regulations and rules shall not enter Hengqin from "first class" Customs. Cargos which are prohibited from exit by laws, administrative regulations and rules shall not enter Hengqin from "second class" Customs through customs declaration.
Enterprises in Hengqin shall not carry out processing trade business of products listed in the Catalogue of Prohibited Commodities in Processing Trade.
Chapter II Supervision and administration on cargos entering and leaving Hengqin and overseas regions
Article 8 The Customs shall, except otherwise regulated by laws, administrative regulations and rules, conduct archival administration on cargos in bond entering and leaving Hengqin and overseas regions, tax exempted cargos in relation to production and cargos of tax refund.
