The Reservist Law of the People's Republic of China, which was adopted at the 38th Session of the Standing Committee of the 13th National People's Congress of the People's Republic of China on December 30, 2022, is hereby issued and shall come into force as of March 1, 2023.

Chapter I General Provisions

Article 1 The Law is enacted in accordance with the Constitution, the Law of the People's Republic of China on National Defense and the Military Service Law of the People's Republic of China with a view to improving the system of reservists, standardizing the administration of reservists, safeguarding the lawful rights and interests of reservists, ensuring the effective performance of duties and missions by reservists, and strengthening the building of the national defense forces.

Article 2 For the purpose of the Law, reservists refer to those citizens who perform the obligation of military service in accordance with the law and are pre-assigned to a regular military troop of the Chinese People's Liberation Army or assigned to a reserve military troop of the Chinese People's Liberation Army for reserve service.
Reservists are divided into reserve officers and reserve soldiers. Reserve soldiers are divided into reserve sergeants and reserve conscripts.
Reservists are members of the armed forces of the State and an important source of supplementation to members of the active forces in wartime.

Article 3 Reservists shall follow the leadership of the Communist Party of China, implement Xi Jinping's thought of building a strong military, insist on the holistic view of national security, carry out military strategic guidelines for the new era, and improve the capability and level of performance of missions and tasks by reservists with military demand as the driver, war preparation as the direction and quality improvement as the focus.

Article 4 Reservists must obey orders, strictly abide by discipline, be brave and tenacious, fear no sacrifice, participate in political education and military training in accordance with provisions, undertake war preparedness duties, carry out non-war military operations, and be ready at any time to be called into battle to defend the motherland.
The State shall protect the status, rights and interests of reservists in accordance with the law. Reservists are entitled to honors and treatments commensurate with the performance of their duties.

Article 5 The Central Military Commission shall lead the work related to reservists.
The political work department of the Central Military Commission shall be responsible for organizing and guiding the administration of reservists; the national defense mobilization department of the Central Military Commission shall be responsible for organizing the grouping, mobilization and recruitment of reservists; and other departments of the Central Military Commission shall be responsible for the work related to reservists within their respective duties.
Central state authorities, local people's governments at or above the county level and military authorities at the same level shall, within their respective duties, effectively carry out the work related to reservists.
The troops to which reservists are assigned (the "troops") shall be responsible for political education, military training, performance of tasks, and work related to selection and supplementation, daily management and retirement from reserve service of their reservists.

Article 6 Local people's governments at or above the county level and the relevant military authorities shall, in light of work needs related to reservists, convene joint military-civilian meetings to coordinate and resolve the relevant issues.
Local people's governments at or above the county level and military authorities at the same level shall include the work related to reservists in the evaluation of supporting the army and giving preferential treatment to the families of servicemen, the evaluation of supporting the government and cherishing the people, and the assessment of the relevant entities and their persons in charge.

Article 7 Authorities, organizations, enterprises and public institutions, people's governments at the town and township level and sub-district offices shall support reservists in performing their reserve duties, and provide assistance in effectively carrying out the work related to reservists.

Article 8 The State shall strengthen IT application in the work related to reservists.
The political work department of the Central Military Commission shall, in conjunction with central state authorities and the relevant departments of the Central Military Commission, coordinate and effectively conduct the construction, maintenance, application and information security management of the information data system.
The relevant departments, entities and individuals shall keep confidential the national secrets, military secrets, personal privacy and personal information that they come to know in the work related to reservists, and shall not divulge or illegally provide others with the said confidential information.

Article 9 The funds required for the work related to reservists shall be included in central and local budgets in accordance with the division principle for fiscal powers and expenditure responsibilities.

Article 10 Reservists who make outstanding contributions in performing their reserve duties shall be commended and rewarded in accordance with the relevant provisions of the State and the army.
Organizations or individuals that make outstanding contributions in the work related to reservists shall be commended and rewarded in accordance with the relevant provisions of the State and the army.

Chapter II Military Ranks for Reservists

Article 11 The State shall implement the system of military ranks for reservists.
Military ranks for reservists are the titles and symbols that distinguish the levels of reservists and indicate their identity, and the status and honors granted to reservists by the Party and the State.

Article 12 Military ranks for reservists are divided into military ranks for reserve officers, military ranks for reserve sergeants and military ranks for reserve conscripts.
Military ranks for reserve officers shall have the following seven grades under two categories:
