Administrative Regulations on the Seismic Resistance of Construction Projects

The Administrative Regulations on the Seismic Resistance of Construction Projects adopted at the 135th executive meeting of the State Council on May 12, 2021 are hereby issued and shall come into force as of September 1, 2021.

Administrative Regulations on the Seismic Resistance of Construction Projects
Chapter I General Provisions
Article 1 The Regulations are formulated in accordance with the Construction Law of the People's Republic of China, the Law of the People's Republic of China on Protecting Against and Mitigating Earthquake Disasters and other laws in order to improve the seismic resistance and disaster prevention capacity of construction projects, reduce the risk of earthquake disasters, and protect the safety of people's lives and property.
Article 2 The Regulations shall apply to the survey, design, construction, assessment, reinforcement, and maintenance related to seismic resistance of construction projects within the territory of the People's Republic of China and the supervision and administration thereof.
Article 3 The seismic resistance of construction projects shall follow the principles of people orientation, comprehensive fortification, and emphasis on key points.
Article 4 The competent housing and urban-rural development department of the State Council shall supervise and administrate the seismic resistance of construction projects across the country in a unified manner. The departments in charge of transport, water resources, industry and information technology, and energy of the State Council shall, as per the division of responsibilities, supervise and administrate the seismic resistance of the relevant professional construction projects across the country.
Competent housing and urban-rural development departments of local people's governments at or above the county level shall supervise and administrate the seismic resistance of construction projects in their respective administrative regions. The departments in charge of transport, water resources, industry and information technology, and energy of local people's governments at or above the county level shall, within their respective responsibilities, supervise and administrate the seismic resistance of the relevant professional construction projects in their respective administrative regions.
Other relevant departments of people's governments at or above the county level shall be responsible for work related to the seismic resistance of construction projects within their respective responsibilities in accordance with the Regulations and other relevant laws and regulations.
Article 5 Entities and personnel engaged in activities related to the seismic resistance of construction projects shall be responsible for the seismic resistance of construction projects in accordance with the law.
Article 6 The State encourages and supports the research, development and application of technologies related to the seismic resistance of construction projects.
People's governments at all levels shall organize the publicity and dissemination of knowledge on the seismic resistance of construction projects to raise the public's awareness of seismic resistance and disaster prevention.
Article 7 The State shall establish a survey system for the seismic resistance of construction projects.
People's governments at or above the county level shall organize the relevant departments to investigate the seismic performance of construction projects, the application of seismic resistance technologies, and industrial development, to comprehensively learn about basic information on the seismic resistance of construction projects, and promote the improvement of the seismic resistance management of construction projects and scientific decision-making.
Article 8 A construction project shall avoid the dangerous areas defined in the special plan for seismic resistance and disaster prevention. If it is indeed unavoidable, seismic fortification measures that meet the use function requirements of the construction project and adapt to the seismic effect shall be adopted.
Chapter II Survey, Design and Construction
Article 9 Newly built, expanded and renovated construction projects shall meet the mandatory standards for seismic fortification.
The relevant departments of the State Council and the competent standardization department of the State Council shall, within their respective responsibilities, formulate and issue the mandatory standards for seismic fortification in accordance with the law.
Article 10 The development entity shall be responsible for the whole process of survey, design and construction of the construction project, specify the mandatory standards for seismic fortification to be adopted in the survey, design and construction contract, verify the survey and design result documents in accordance with the contract, and organize the inspection and acceptance of the project, to ensure that the construction project meets the mandatory standards for seismic fortification.
The development entity shall not ask either explicitly or implicitly the entities and personnel engaged in survey, design, and construction to violate the mandatory standards for seismic fortification and reduce the seismic performance of the project.
Article 11 The survey document on a construction project shall state the type of site, analyze the seismic effect of the site, and put forward suggestions on site selection and response to poor geological conditions.
The design document on a construction project shall state the intensity and category of seismic fortification and proposed seismic fortification measures. For a construction project that adopts seismic isolation and absorption technologies, the design document shall set forth clear requirements for the technical performance, inspection and testing, construction and installation, use and maintenance of seismic isolation and absorption devices.
Article 12 For the following construction projects located in areas with high-intensity fortification and key areas under earthquake surveillance and prevention, the design entity shall, in the preliminary design stage, compile a special chapter on seismic fortification of such construction projects in accordance with the relevant national provisions as a part of the design document:
1. major construction projects;
2. construction projects that may cause severe secondary disasters during an earthquake; and
3. construction projects whose use functions cannot be interrupted or need to be restored as soon as possible during an earthquake.
Article 13 For any super high-rise construction project, the design entity shall provide an explanation in the design document, and the development entity shall, in the preliminary design stage, submit the design document and other materials to the competent housing and urban-rural development department of the people's government of the province, autonomous region or municipality directly under the Central Government for seismic fortification approval.
