Chapter I General Provisions
Article 1 This Law is formulated in accordance with the Constitution with a view to improving the organizational and working systems of the National People's Congress and its Standing Committee, safeguarding and regulating the exercise of their functions and powers, upholding and perfecting the system of people's congresses, and ensuring that the people are masters of the country.
Article 2 The National People’s Congress is the supreme organ of state power. Its permanent organ is the Standing Committee of the National People’s Congress.
Article 3 The National People's Congress and its Standing Committee shall adhere to the leadership of the Communist Party of China, follow the guidance of Marxism-Leninism, Mao Zedong Thought, Deng Xiaoping Theory, the important thought of "Three Represents", the Scientific Outlook on Development and Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, and exercise their functions and powers in accordance with the provisions of the Constitution and laws.
Article 4 The National People's Congress shall be democratically elected, accountable to and supervised by the people.
The National People's Congress and its Standing Committee shall adhere to democracy in the whole process, always keep close contact with the people, listen to their opinions and suggestions, embody their will and protect their rights and interests.
Article 5 The National People's Congress and its Standing Committee shall exercise the legislative power of the State, decide on major matters, supervise the implementation of the Constitution and laws, safeguard the unity, dignity and authority of the socialist legal system, and build a socialist country ruled by law.
Article 6 The National People's Congress and its Standing Committee shall practice the principle of democratic centralism, give full play to democracy and exercise their functions and powers collectively.
Article 7 The National People's Congress and its Standing Committee shall proactively carry out foreign exchanges and strengthen exchanges and cooperation with parliaments of various countries, as well as international and regional parliamentary organizations.
Chapter II Sessions of the National People's Congress
Article 8 Each National People’s Congress shall have a term of five years.
A session of the National People’s Congress shall be held once every year and shall be convened by the Standing Committee of the National People’s Congress. If the Standing Committee of the National People’s Congress deems it necessary, or one-fifth or more of deputies to the National People’s Congress so propose, a session of the National People’s Congress may be specially convened.
Article 9 After deputies to the National People's Congress are elected, their credentials shall be examined by the Credentials Committee of the Standing Committee of the National People's Congress.
The Standing Committee of the National People’s Congress shall, on the basis of the reports submitted by the Credentials Committee, confirm the qualifications of deputies or invalidate the election of individual deputies, and publish the list of confirmed deputies prior to the first session of each National People's Congress.
Deputies to the National People's Congress who are elected through by-elections shall have their credentials examined in accordance with the provisions of the preceding paragraphs.
Article 10 Deputies to the National People's Congress shall be grouped into delegations based on the organizations that elected them. Each delegation shall elect a head and deputy heads.
Before each session of the National People's Congress is held, the delegations shall discuss matters concerning preparations for the session put forward by the Standing Committee of the National People's Congress; during the session, the delegations shall deliberate on the various bills and proposals submitted to the National People’s Congress, and the heads of delegations or representatives chosen by them may express, on behalf of such delegations, opinions on the bills and proposals under deliberation at meetings of the presidium or at plenary sessions of the Congress.
Article 11 Before each session of the National People's Congress, a preparatory meeting shall be held to elect a presidium and a secretary-general for the session, adopt an agenda for such session and make decisions on other preparatory matters.
The draft membership list of the presidium and the secretary-general shall be proposed by the Chairman's Council of the Standing Committee of the National People’s Congress and submitted to the preparatory meeting after deliberation and approval by the meeting of the Standing Committee.
Article 12 The presidium shall preside over sessions of the National People's Congress.
The presidium shall elect several standing chairmen to convene and preside over presidium meetings.
The presidium shall elect several of its members to respectively serve as executive chairmen of each plenary session of the Congress and designate one of them as chairperson of a plenary session.
