The Decision of the General Administration of Customs on Revising Some Rules, which was deliberated and adopted at the executive meeting of the General Administration of Customs on December 11, 2020, is hereby promulgated and shall come into force as of February 1, 2021.

Decision of the General Administration of Customs on Revising Some Rules

In order to implement the requirements of the State Council on cleaning up the relevant laws and regulations involved in the Civil Code, the General Administration of Customs ("GAC") has decided to revise three rules including the Measures of the Customs of the People's Republic of China for the Supervision and Administration of Processing Trade Goods.

I. The Measures of the Customs of the People's Republic of China for the Supervision and Administration of Processing Trade Goods (issued by Order of the General Administration of Customs No.219 and amended by Orders of the General Administration of Customs No.235, No.240 and No.243) shall be amended as follows:
Paragraph 2 of Article 6 shall be amended to read: "After the approval of the customs and the completion of the relevant procedures, processing trade goods can be pledged."

II. The Administrative Provisions of the Customs of the People's Republic of China on Statistical Work (issued by Order of the General Administration of Customs No.242) shall be amended as follows:
Article 12 shall be amended to read: "The results of customs statistical supervision may serve as the basis for assessing the operational performance of customs business and implementing risk management."

III. The Administrative Measures for the Prevention and Control of AIDS at Ports (issued by Order of the former General Administration of Quality Supervision, Inspection and Quarantine No.96 and amended by Order of the former General Administration of Quality Supervision, Inspection and Quarantine No.139 and Order of the General Administration of Customs No.238) shall be amended as follows:
1. "Competent customs" specified in Articles 4 and 11 shall be amended to read "customs directly under the General Administration of Customs".
2. "Frontier inspection organ" specified in Article 5 shall be amended to read "immigration administrative department", and "jointly and effectively prevent and control AIDS at ports and monitor the people infected with HIV and AIDS patients" shall be amended to read "jointly and effectively prevent and control AIDS at ports and manage the people infected with HIV and AIDS patients".
3. One article shall be added as Article 7, reading "No entity or individual may discriminate against people infected with HIV, AIDS patients, and their family members. The lawful rights and interests enjoyed by the people infected with HIV, AIDS patients, and their family members shall be protected by law."
4. Article 8 shall be deleted.
5. One article shall be added as Article 8, reading: "The customs shall conduct epidemiological investigations on people infected with HIV and AIDS patients that have been discovered, and provide AIDS prevention and control consulting services."
6. One article shall be added as Article 9, reading: "Inbound arrivals suffering AIDS or infected with HIV shall cooperate in accepting the epidemiological investigations made by the customs and the corresponding medical guidance when entering the country."
7. "With the HIV testing result" specified in Articles 9 and 10 shall be deleted.
8. "The competent customs shall carry out the monitoring of AIDS according to the working rules for the monitoring" in Paragraph 2 of Article 11 shall be amended to read "The customs directly under the General Administration of Customs shall organize the monitoring of AIDS according to the working rules for the monitoring."
9. Article17 shall be deleted.
10. The order of the articles shall be adjusted accordingly.

This Decision shall come into force as of February 1, 2021.
