The Decision of the Standing Committee of the National People's Congress on Revising the Electoral Law of the People's Republic of China for the National People's Congress and Local People's Congresses at All Levels, adopted at the 22nd session of the Standing Committee of the 13th National People's Congress of the People's Republic of China on October 17, 2020, is hereby promulgated and shall come into effect as of October 18, 2020.

Decision of the Standing Committee of the National People's Congress on Revising the Electoral Law of the People's Republic of China for the National People's Congress and Local People's Congresses at All Levels

It was decided at the 22nd session of the Standing Committee of the 13th National People's Congress to revise the Electoral Law of the People's Republic of China for the National People's Congress and Local People's Congresses at All Levels as follows:
An article is added as Article 2 which reads: “The election of deputies to the National People's Congress and local people's congresses at all levels shall adhere to the leadership of the Communist Party of China, giving full play to democracy and acting in strict accordance with the law.”
II. Article 11 is revised to be Article 12 with Item 3 of Paragraph 1 thereof revised to read: “3. the base number of deputies to the people's congress of a city with no subordinate district, a municipal district, a county or an autonomous county shall be 140. One more deputy may be added for every 5,000 people; however, if the population there exceeds 1.5 million, the total number of deputies shall not exceed 450; if the population is less than 50,000, the total number of deputies may be less than 140.”
Item 4 of Paragraph 1 thereof is revised to read: “4. the base number of deputies to the people's congress of a township, a nationality township or a town shall be 45. One more deputy may be added for every 1,500 people; however, the total number of deputies shall not exceed 160; if the population is less than 2,000, the total number of deputies may be less than 45.”
III. Article 13 is revised to be Article 14 with a paragraph added as Paragraph 2 thereof which reads: “If the number of deputies is reconfirmed in accordance with the preceding paragraph, the standing committee of the people's congress of the province, autonomous region or municipality directly under the Central Government shall report the reconfirmed number of deputies to the Standing Committee of the National People's Congress for record-filing within 30 days.”
IV. Article 57 is revised to be Article 58 with Paragraph 2 thereof revised to read: “State functionaries who commit any of the acts set out in the preceding paragraph shall also be subject to administrative sanctions imposed by the supervisory agency or punishments by the agencies or entities where they work.”
The number of deputies to the people's congress of a city with no subordinate district, a municipal district, a county, an autonomous county, a township, a nationality township or a town shall be reconfirmed in accordance with this Decision.
This Decision shall come into effect as of October 18, 2020.
The Electoral Law of the People's Republic of China for the National People's Congress and Local People's Congresses at All Levels shall be revised in accordance with this Decision and will be re-promulgated after adjusting the sequence of articles accordingly.
