The Administrative Measures for Scrapped Motor Vehicle Recycling are hereby promulgated for implementation as of June 1, 2019.

Administrative Measures for Scrapped Motor Vehicle Recycling
Article 1 The Measures are hereby formulated in order to standardize the recycling activities of scrapped motor vehicles, protect the environment, promote the development of circular economy, and safeguard the road traffic safety.
Article 2 For the purpose of the Measures, "scrapped motor vehicles" refer to the motor vehicles that shall be scrapped in accordance with the Law of the People's Republic of China on Road Traffic Safety.
The motor vehicles that are not subject to the Law of the People's Republic of China on Road Traffic Safety and that are scrapped by their owners voluntarily shall be governed by the Measures.
Article 3 The State encourages the scrapping and replacement of old and used vehicles in specific areas. The specific measures shall be separately formulated by the relevant department under the State Council.
Article 4 The department in charge of the administration of scrapped motor vehicle recycling under the State Council is responsible for the supervision and administration of scrapped motor vehicle recycling (including dismantling, hereinafter the same) nationwide, and the public security department, ecological environment department, industry and information technology department, transport department, market regulation department and other departments under the State Council are responsible for the relevant supervision and administration of scrapped motor vehicle recycling within their respective scope of duties.
The departments in charge of the administration of scrapped motor vehicle recycling of local people's governments at or above the county level shall carry out the supervision and administration of the scrapped motor vehicle recycling activities within their respective administrative regions. The public security departments, ecological environment departments, industry and information technology departments, transport departments, market regulation departments and other departments of local people's governments at or above the county level shall carry out the relevant supervision and administration of the scrapped motor vehicle recycling activities within their respective administrative regions based on the scope of their respective duties.
Article 5 The State implements the system for qualification accreditation of the scrapped motor vehicle recycling enterprises. No entity or individual may engage in the scrapped motor vehicle recycling activities without obtaining qualification accreditation.
The State encourages motor vehicle producers to engage in the scrapped motor vehicle recycling activities. Motor vehicle producers shall bear the responsibility of producers in accordance with the relevant provisions of the State.
Article 6 To obtain the qualification accreditation for scrapped motor vehicle recycling, the following conditions shall be met:
1. having the qualification of a corporate legal person;
2. having storage and dismantling sites in line with the requirements of the relevant laws, regulations and mandatory standards on environmental protection as well as dismantling equipment, facilities and dismantling operation specifications; and
3. having professional technical personnel who are suitable for the dismantling activities of scrapped motor vehicles.
Article 7 An enterprise intending to engage in the scrapped motor vehicle recycling activities shall file an application with the department in charge of the administration of scrapped motor vehicle recycling of the people's government of the province, autonomous region or municipality directly under the Central Government, which shall carry out examination in accordance with the law, and shall issue a qualification certificate if the enterprise meets the conditions, or shall not carry out qualification accreditation and shall give written reasons if the enterprise does not meet the conditions.
The departments in charge of the administration of scrapped motor vehicle recycling of people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall make full use of advanced technological means such as computer network and promote online application and online acceptance to provide convenience for applicants.
