Administrative Provisions for the Record-filing of Export Food Manufacturers (Revised in 2018)

Chapter I General Provisions
Article 1 For the purpose of strengthening the food safety and hygiene administration of export food manufacturers and regulating the record-filing administration of export food manufacturers, these Provisions are formulated in accordance with the Food Safety Law of the People's Republic of China, the Export and Import Commodities Inspection Law of the People's Republic of China and their implementing regulations, and other relevant laws and administrative regulations.
Article 2 The State adopts a record-filing administration system for export food manufacturers.
Article 3 These Provisions shall apply to the record-filing administration of export food manufacturers within the territory of the People's Republic of China.
Article 4 The General Administration of Customs ("GACC") shall uniformly organize and conduct the management of the record-filing of export food manufacturers nationwide. The competent customs shall specifically conduct the record-filing, supervision and inspection of export food manufacturers within its administrative area.
Article 5 Export food manufacturers shall establish and implement a food safety and hygiene control system that centers on hazard analysis and prevention and control measures, and the system shall also include a food defense plan. Export food manufacturers shall ensure an effective implementation of the food safety and hygiene control system, and guarantee that the production, processing and storage of export food maintain sustained compliance with China's laws and regulations as well as the safety and hygiene requirements for export food manufacturers, and the requirements of laws and regulations of import countries (regions).
Chapter II Record-filing Procedures and Requirement
Article 6 Where an export food manufacturer fails to perform statutory record-filing obligations in accordance with law, or its record-filing fails to satisfy requirements upon review, its products may not be exported.
Article 7 When an export food manufacturer makes a record-filing, it shall submit the following documentation and supporting materials to the competent customs in the locality where it is situated, and it shall be responsible for their authenticity:
1. self-statement made or prepared by the manufacturer about its commitment on the compliance with the relevant laws, regulations and requirements;
2. basic information on production conditions of the manufacturer, food production and processing techniques, use of food raw materials and auxiliary materials, hygiene management personnel, etc.;
Article 8 Customs shall, within five days of the record-filing application of an export food manufacturer, carry out initial review on the record-filing materials submitted by the manufacturer. Where the submitted materials are complete and comply with statutory forms, such application shall be accepted; where the materials are not complete and do not comply with statutory forms, the export food manufacturer shall be informed at a time of all documents needed to be made up.
Article 9 Customs shall organize a panel of experts to complete a review and issue export review reports after the acceptance of the record-filing application.
