The Administrative Measures for the Labeling of Agricultural Genetically Modified Organisms, adopted at the fifth executive meeting of the Ministry of Agriculture on July 11, 2001, are hereby promulgated for implementation as of March 20, 2002.
Appendix: Administrativr Measures for the Labeling of Agricultural Genetically Modified Organisms
Article 1 The Measures are formulated in accordance with the Regulations on the Administration of Agricultural Genetically Modified Organisms Safety in order to strengthen the administration of labels of agricultural genetically modified organisms, regulate the sales of agricultural genetically modified organisms, guide the production and consumption of agricultural genetically modified organisms, and protect consumers' right to know.
Article 2 The State applies the labeling system to agricultural genetically modified organisms. The catalog of agricultural genetically modified organisms subject to labeling administration shall be formulated, adjusted and released by the competent administrative department for agriculture under the State Council in concert with the relevant departments of the State Council.
Article 3 The sales of agricultural genetically modified organisms listed in the catalog of agricultural genetically modified organisms subject to labeling administration within the territory of the People's Republic of China shall be subject to the Measures.
All agricultural genetically modified organisms that are listed in the catalog of agricultural genetically modified organisms subject to labeling administration and used for sale shall be labeled; those not labeled at all or not labeled according to the relevant regulations shall not be imported or sold.
Article 4 The Ministry of Agriculture shall be responsible for the approval, supervision and administration of the labeling of nationwide agricultural genetically modified organisms.
The competent administrative departments for agriculture of the local people's governments at or above the county level shall be responsible for the supervision and administration of the labeling of agricultural genetically modified organisms within their respective administrative regions.
The General Administration of Quality Supervision, Inspection and Quarantine shall be responsible for the inspection and verification of the labeling of imported agricultural genetically modified organisms at ports.
Article 5 Agricultural genetically modified organisms listed in the catalog of agricultural genetically modified organisms subject to labeling administration shall be labeled by the entities or individuals producing or repacking the products; and shall be re-labeled if the said entities and individuals open the original packages for sale.
