Chapter I General Provisions
Article 1 The Administrative Measures of the Customs of the People's Republic of China for Transportation Enterprises Undertaking the Road Transportation of Goods under Customs Supervision within the Territory of China and the Vehicles and Drivers Thereof (Revised in 2015) (hereinafter referred to as the "Measures") are formulated in accordance with the Customs Law of the People's Republic of China (hereinafter referred to as the "Customs Law") and other relevant regulations with a view to strengthening the administration over domestic transportation enterprises undertaking the transportation of goods under customs supervision and the vehicles and drivers thereof.
Article 2 For the purpose of the Measures, the domestic transportation enterprises, vehicles and drivers refer to the enterprises, vehicles and drivers undertaking the transportation of goods under customs supervision within the territory of China after being registered or filed for record with the customs in accordance with the Measures.
Article 3 A transportation enterprise or vehicle shall apply for going through the registration formalities with the competent customs office directly under the General Administration of Customs or the subordinate customs office (hereinafter referred to as the "competent customs office"), and a driver shall go through the record-filing formalities.
Article 4 In case the customs manage the registration materials of transportation enterprises and vehicles and registration materials of record-filing of drivers and share the data over the computer network, then no more formalities for record-filing at different places are required.
Chapter II Registration
Article 5 A transportation enterprise undertaking the transportation of goods under customs supervision shall meet the following requirements:
1. having the status of a legal person;
2. having completed the registration upon approval of the industry and commerce authority that is in line with the business scope of the transportation enterprise;
Article 6 A transportation enterprise shall submit the following documents to the customs when going through the registration formalities:
1. an Application for Registration of Domestic Transportation Enterprises Undertaking the Transportation of Goods under Customs Supervision;
2. a photocopy of the Business License issued upon verification by the administrative department for industry and commerce; and
3. the name list and record-filing materials of drivers of vehicles undertaking the transportation of goods under customs supervision. In case an enterprise changes its drivers, it shall go through the formalities for the record-filing of change of the drivers with the customs in time.
If the competent customs may obtain the materials as required in the preceding paragraph through network sharing, it is unnecessary to submit such materials separately.
Article 7 The customs shall examine the qualification conditions of a transportation enterprise and the relevant certificates submitted thereby; if the enterprise is found to be qualified, a Certificate of Registration of Road Transportation Enterprises Carrying Goods under Customs Supervision within the Territory of China (hereinafter referred to as the "Certificate of Registration") shall be issued thereto.
Article 8 The vehicles undertaking the transportation of goods under customs supervision shall be either vans or container tractors, or bulk trucks upon the approval of the customs.
