People's governments of all provinces, autonomous regions and municipalities directly under the Central Government, and all ministries and commissions of the State Council and all departments directly under the State Council,
The logistics industry runs through the primary, secondary and tertiary industries, connects production and consumption, and features a wide range of involved fields, great development potential and strong driving role. Promoting cost reduction and efficiency improvement in the logistics industry is of great significance to facilitating the adjustment of industrial structure and the coordinated development of regions, fostering new driving forces for economic development and enhancing the overall operating efficiency of the national economy. Upon approval by the State Council, the following opinions are hereby put forward in accordance with the decision and deployment of the Central Committee of the Communist Party of China ("CPC") and the State Council with regard to further promoting the supply-side structural reform and reducing the cost of enterprises engaging in the real economy, in order to further advance cost reduction and efficiency improvement in the logistics industry, strive to create a good environment for the development of the logistics industry, raise the development level of the logistics industry and facilitate the healthy development of the real economy.
I. Deepening the Reform of Streamlining Administration, Delegating Powers and Improving Regulation and Services to Vitalize Logistics Operators
1. Optimizing the management of road transport. In 2017, establish the national network of parallel licensing for the trans-provincial transport of large items, under which the province as the place of shipment accepts applications for the said license in a unified manner and other provinces along the way shall conduct parallel examination and approval, so as to achieve the issuance of a license at one place and passage through the whole route. Optimize the management of road transport of partial low-risk gases in accordance with international rules to facilitate safe and convenient transport (carried out by the Ministry of Transport ("MOT")). Improve administrative policies for the passage of urban distribution vehicles, and plan as a whole and optimize measures for traffic safety and traffic control. Encourage commercial and logistics enterprises to cooperate in carrying out joint distribution and distribution at night (carried out by the Ministry of Public Security ("MPS"), the MOT and the Ministry of Commerce ("MOFCOM")).
2. Regulating law enforcement related to road freight transport. Drive the normalization and institutionalization of the model of joint law enforcement for overload control under which, based on overload detection stations on roads, road administrations under transport departments are responsible for supervising the elimination of illegal acts and traffic management authorities under public security departments shall separately impose punishments and adopt the accumulative score system so as to avoid repeated fines, formulate a feasible implementation plan as soon as possible, and strengthen the supervision of the implementation thereof throughout the country. In principle, lead all freight vehicles involved in illegal oversize and overload transport to overload detection stations on roads established upon approval by people's governments at the provincial level for on-site inspection and punishment, in which such freight vehicles shall take the initiative to provide cooperation. Ensure that the setting up of overload detection stations on roads in all regions is scientific, reasonable and in line with the practice of governance work (carried out by the MOT, the MPS and people's governments at the provincial level). Turn over fines related to road freight transport to the state treasury in accordance with the centralized state treasury collection system, and implement the system of separating fines from payments (carried out by the Ministry of Finance ("MOF") in concert with the MOT and the MPS). Promptly formulate the list of punishments concerning road freight transport and specify punishment standards in accordance with laws and regulations, and publish the same to the public. Strictly put into practice such measures as regulation of major freight sources, "imposition of punishments on freight vehicles, vehicle drivers, transport enterprises and freight station operators in the case of any overload" according to the law, and weighing at the entrance of highways and urging overloaded vehicles to go back for unloading. Strictly implement law enforcement procedures for freight vehicles, and require law enforcement personnel to carry lawful documents and equipment for the supervision of law enforcement when they enforce the law at the scene (carried out by the MOT, the MPS and people's governments at the provincial level according to the division of duties). Perfect the mechanism of guaranteeing financial funds for law enforcement related to road freight transport (carried out by the MOF in concert with the MOT, the MPS and people's governments at the provincial level). Improve the national supervision and reporting platform for road-related law enforcement, and smooth complaint and reporting channels (carried out by the MOT and the MPS).
3. Improving the license examination system for road freight transport and vehicle-related inspection and testing systems. Further perfect the qualification and credit management system for drivers engaging in road freight transport, apply information technologies to promote the adoption of an accumulative score and handling system for breaches of laws and faith, actively boost the online handling and inquiry with respect to endorsement for results of annual examination, and explore the implementation of the non-local annual examination of road transport certificates for vehicles in certain provinces (carried out by the MOT).
