Cultural departments (bureaus) of all the provinces, autonomous regions and municipalities directly under the Central Government, the Culture, Radio and Television Bureau of Xinjiang Production and Construction Corps, and the general (comprehensive) administrative law enforcement teams for the cultural market of Tibet Autonomous Region, Beijing Municipality, Tianjin Municipality, Shanghai Municipality and Chongqing Municipality,

In order to practically strengthen the administration for business activities of online performances, regulate market order and promote the sound and orderly development of the online performance industry, the Ministry of Culture ("MOC") has formulated the Administrative Measures for Business Activities of Online Performances(these "Measures") in accordance with the Administrative Measures for Internet Information Services, the Interim Administrative Provisions on Internet Culture and other relevant laws and regulations, these Measures are hereby issued for your earnest implementation,.

Online performances are an important integral part of network culture. The administrative cultural departments and comprehensive administrative law enforcement agencies for the cultural market at all the levels shall strengthen the administration and regulation for the online performance market, and actively guide operators of network culture to conduct business activities in accordance with laws and regulations and consciously provide excellent online performances with healthy, positive and good contents and that are favorable for carrying forward socialist core values, in order to promote the prosperous development of China's network culture.

Administrative Measures for Business Activities of Online Performances

Article 1 In order to practically strengthen the administration for business activities of online performances, regulate the market order of online performances and promote the sound and orderly development of the industry, the Administrative Measures for Business Activities of Online Performances (these "Measures") are hereby formulated in accordance with the Administrative Measures for Internet Information Services, the Interim Administrative Provisions on Internet Culture and other relevant laws and regulations.

Article 2 The online performances mentioned herein refer to the Internet cultural products with live cultural and artistic performances as major contents and that are transmitted in real time via information networks such as Internet, mobile communication network and mobile Internet or are uploaded for communication in the audio-visual form.
The business activities of online performances refer to behaviors of providing products and services of online performances to the public and make profits from charging users, e-commerce, advertising, sponsorship, etc.
The business activities of transmitting in real time the contents of skills of online games presented or narrated via information networks such as Internet, mobile communication networks and mobile Internet or uploading such contents for communication in the audio-visual form shall be administered pursuant to these Measures.

Article 3 Entities engaging in business activities of online performances shall comply with the Constitution and relevant laws and regulations, adhere to the orientation of serving people and socialism and maintain the progressive direction of advanced socialist culture, and consciously carry forward socialist core values.
