The Decision of the Standing Committee of the National People's Congress on Revising Six Laws Including the Energy Conservation Law of the People's Republic of China, adopted at the 21st session of the Standing Committee of the Twelfth National People's Congress of the People's Republic of China on July 2, 2016, is hereby promulgated.

Under the Decision of the Standing Committee of the National People's Congress on Revising Six Laws Including the Energy Conservation Law of the People's Republic of China, the revisions made to the Energy Conservation Law of the People's Republic of China, the Water Law of the People's Republic of China, the Flood Prevention Law of the People's Republic of China, the Law of the People's Republic of China on the Prevention and Treatment of Occupational Diseases and the Waterway Law of the People's Republic of China shall come into force as of the promulgation date, and those made to the Law of the People's Republic of China on Environment Impact Assessment shall come into force as of September 1, 2016.

Decision of the Standing Committee of the National People's Congress on Revising Six Laws Including the Energy Conservation Law of the People's Republic of China

The 21st session of the Standing Committee of the Twelfth National People's Congress has decided to:

I. Make revisions to the Energy Conservation Law of the People's Republic of China
1. Article 15 is revised to read: "The State implements an energy conservation assessment and audit system for fixed asset investment projects. For projects that do not meet the mandatory energy conservation standards, a construction entity may not start construction; and the completed construction projects may not be put into production or use. For government-invested projects that do not meet the mandatory energy conservation standards, the authorities legally in charge of project examination and approval shall not approve the construction thereof. The specific measures shall be formulated by the department regulating energy conservation of the State Council in concert with other relevant departments of the State Council.'
2. Paragraph 1 of Article 68 is revised to read: "Where an authority in charge of examination and approval of government-invested projects, in violation of the provisions of this Law, approve the construction of any project that does not meet the mandatory energy conservation standards, the person in direct charge and the person directly liable shall be punished in accordance with the law.'

II. Make revisions to the Water Law of the People's Republic of China
Article 19 is revised to read: "Water projects shall be constructed in conformity with the overall plans for river basins. For construction of any waterworks on the key rivers and lakes defined as such by the State or on the rivers or lakes that run or straddle across provinces, autonomous regions or municipalities directly under the Central Government, an construction entity may not start construction without a written consent signed by relevant river basin authority to show that the waterworks meet the requirements of the comprehensive river basin plan. For construction of waterworks on other rivers and lakes, the construction entity may not start construction without a written consent signed by the competent administrative departments for water resources of the local people's governments at or above the county level within the limits of their administrative powers to show that the waterworks meet the requirements of the comprehensive river basin plan.
