Circular of the Ministry of Land and Resources on Strengthening and Standardizing the Administration of Agreement-based Transfer of Mining Rights

The land and resources departments of all provinces, autonomous regions, and municipalities directly under the Central Government, the China Geological Survey, the Armed Police Gold Command, and other units directly under the MLR:

In order to thoroughly implement the resolutions of the Central Government in tackling prominent problems in the engineering and construction sector, and intensify efforts to combat corruption in the mining area, the land and resources departments at all levels shall actively promote the public bidding, auction, and listing in agreement-based transfer of mining rights pursuant to the relevant laws and regulations, and strictly control agreement-based transfer of mining rights in accordance with the relevant approval authority and procedures so as to reduce the number of agreement-based transfers and promote the construction of the mining rights market. For this reason, the Ministry of Land and Resources issued the "Circular on Strictly Controlling and Standardizing the Administration of Agreement-based Transfer of Mining Rights" (Guo Tu Zi Fa [2012] No.80, the "Document") on May 15, 2012.

In accordance with the relevant requirements of the "Decisions of the State Council on Cancelling Non-administrative Review" (Guo Fa [2015] No.27) regarding the examination and approval of applications for agreement-based transfer of exploration and mining rights, the Document has been amended.
