The people's governments of all provinces, autonomous regions and municipalities directly under the Central Government, and all ministries and commissions of the State Council, and all institutions directly under the State Council:
In recent years, the e-commerce of China has developed rapidly, which has created the new demand for consumption, triggered a new investment boom, opened up new channels for employment income, and provided new space for the public to start business and innovate. The e-commerce is also accelerating to be integrated with the manufacturing industry to promote the transformation and upgrading of the service industry and create the newly-developing types of business, making it become the new strength of provision for public products and services and the new impetus of economic development. Meanwhile, the development of e-commerce is faced with the issues such as maladjustment of management mode, imperfectness of credit system, lack of standardization of market order etc., which urgently need actions to be taken to solve. At present, China has entered the decisive stage of comprehensively building a moderately prosperous society, and in order to reduce the obstacles of institution and mechanism that restrict the development of e-commerce, further play important roles of e-commerce in fostering new economic driving force, creating "double-engines", realizing "double-goals" and other aspects, the following opinions are hereby proposed:
I. Guiding Ideology, Basic Principles and Major Goals
1. Guiding ideology. Comprehensively implement the spirits of the 18th CPC National Congress, the Second, the Third and the Fourth Plenary Sessions of the 18th CPC Central Committee, in accordance with the decisions and arrangements of the Party Central Committee and the State Council, adhere to depend on the reform to promote the scientific development, actively adapt to and guide a new economic development normal, spare no effort to solve the deep-rooted conflicts and major issues in e-commerce development, vigorously propel the innovation in policy, management and service, accelerate to build an open, standard, honest and safe development environment of e-commerce, further motivate the innovative impetus, creative potential and business pioneering vigor of the e-commerce, accelerate to propel the strategic adjustment of economic structure and realize the quality improvement, efficiency improvement and upgrade of economy.
2. Basic principles. Firstly, actively propel. Actively act and support the development. Positively coordinate and solve all kinds of conflicts and issues in the development of e-commerce. Strengthen service in such aspects as the openness of governmental resources, network security guarantee, investment and financing support, infrastructure and credit system construction. Propel the rationalization of taxes and charges of e-commerce enterprises to reduce their burdens. Further release the development potential of e-commerce and improve the level of innovative development of e-commerce. Secondly, standardize step by step. Streamline administration and delegate powers to lower-level governments and to society in general while improve regulation. The market subject without prohibition by law may act while the government authority unauthorized by law may not act, which minimize the administrative intervention to the market of e-commerce. At the time of loosening the market access, gradually standardize the market order in the process of development, build entrepreneurship development environment with fair competition, further motivate the social entrepreneurial vigor and broaden the innovative and developmental fields of e-commerce. Thirdly, strengthen the guidance. Grasp the trend and guide in the light of the trend. Strengthen the studies of forward-looking, emerging and tendentious issues in the development of e-commerce, timely strengthen the support and guidance to the enterprises in the aspects such as the innovation of business model, research and development of key technology, international market development, guide the e-commerce to the development of "double-engines" and "double-goals", further enhance the innovative impetus of enterprises and accelerate the pace of innovative development of e-commerce.
3. Major goals. By 2020, the large e-commerce market with uniform opening, orderly competition and security and reliability will be basically established. The deep integration of e-commerce and other industries becomes the material platform for promoting entrepreneurship, stabilizing employment and improving the service of people's livelihood, which play a critical role in the synchronous development of industrialization, informatization, urbanization and agricultural modernization.
II. Build loose development environment
4. Lower the requirements for market access. Totally clean up the existing matters subject to pre-ante approval in the field of e-commerce in which all matters without the basis of law and regulation are cancelled, and strictly prohibit illegally setting the administrative permission and increasing the conditions and procedures of administrative permission. (Respectively undertaken by the Approval and Reform Office of State Council and relevant departments according to the assignment of their responsibilities) Further simplify the registration of registered capital, deeply promote the reform from "certificate before license" to "license before certificate" in the field of e-commerce. (The State Administration for Industry and Commerce (hereinafter referred to as the "SAIC"), the State Commission Office of Public Sectors Reform) Implement the Reform Scheme for Registered Capital Registration System, broaden the registration conditions of domicile (business location) for the market subject of e-commerce and perfect the relevant management measures. (The people's governments at provincial level) Propel the implementation of recordkeeping management to the express enterprises setting terminal outlets of unincorporated express delivery. (China Post) Simplify the approval process for the overseas listing of e-commerce enterprises in the territory and encourage the cross-border RMB direct investment in the field of e-commerce. (The National Development and Reform Commission (hereinafter referred to as the "NDRC"), the Ministry of Commerce (hereinafter referred to as the "MOFCOM"), the State Administration of Foreign Exchange (hereinafter referred to as the "SAFE"), China Securities Regulatory Commission (hereinafter referred to as the "CSRC") and the People's Bank of China (hereinafter referred to as the "PBC")) Release the restriction of shareholding ratio by the foreign merchant in the e-commerce business invested by the foreign merchant. (The Ministry of Industry and Information Technology (hereinafter referred to as the "MIIT"), the NDRC and the MOFCOM) Explore to establish the marketization mechanism of e-commerce service in such industries as energy, railway and public utilities. 5. Reasonably reduce the burden of tax. The enterprises engaging in the e-commerce which are recognized as high-tech enterprises legally enjoy the relevant preferential policies for high-tech enterprises. (The Ministry of Science and Technology (hereinafter referred to as the "MOST"), the Ministry of Finance (hereinafter referred to as the "MOF") and the State Administration of Taxation (hereinafter referred to as the "SAT")) Accelerate to propel "the collection of value-added tax in lieu of business tax" and gradually include the tourism e-commerce, e-commerce of life service and relevant industries in the scope of "the collection of value-added tax in lieu of business tax". 6. Increase financial service support. Establish and perfect the investment and financing mechanisms featuring diversity and multi-channel for the development of e-commerce. (Relevant departments shall, in accordance with the assignment of their responsibilities,) study the relevant policies encouraging the listing of eligible internet enterprises in the territory.
