The Administrative Measures on Scrap Vehicle Collection, adopted at the 41st executive meeting of the State Council on June 13, 2001, are hereby promulgated and shall take effect as of the date of the promulgation.

Appendix: Administrative Measures on Scrap Vehicle Collection
Article 1 In order to regulate the scrap vehicle collection activities, strengthen the management of scrap vehicle collection, safeguard the road traffic order and the safety of people's life and property, and protect the environment, the Administrative Measures on Scrap Vehicle Collection (hereinafter referred to as the "Measures") are hereby formulated.
Article 2 For the purpose of the Measures, the scrap vehicles (including motorcycles and agricultural vehicles, hereinafter the same) refer to the motor vehicles which reach the national standards for being discarded as unserviceable, or which do not reach the national standards for being discarded as unserviceable but fail to meet the national technical requirements for safe running of motor vehicles or the national standards for pollutants discharged by motor vehicles upon inspection as their engines or chasses are severely damaged.
For the purpose of the Measures, the reassembled vehicle refers to the motor vehicle assembled with the engine, steering, transmission, front and rear axles, frame (hereinafter collectively referred to as the "Five Main Parts") and other spare parts of scrap vehicles.
Article 3 The State Economic and Trade Commission is responsible for organizing the supervision and administration of scrap vehicle collection (including dismantling, hereinafter the same) nationwide, and the public security department, industrial and commercial administrative department and other relevant departments under the State Council are responsible for the relevant supervision and administration over scrap vehicle collection within their respective scope of duties and responsibilities.
The economic and trade management departments of local people's governments at and above the county level shall carry out the supervision and administration over the scrap vehicle collection activities within their respective administrative regions. The public security departments, industrial and commercial administrative departments of local people's governments at and above the county level shall carry out the relevant supervision and administration over the scrap vehicle collection activities within their respective administrative regions based on the scope of their respective duties and responsibilities.
Article 4 The State encourages the scrap and renewal of vehicles, and the specific measures shall be formulated by the State Economic and Trade Commission, in concert with the Ministry of Finance.
Article 5 Local people's governments at and above the county level shall strengthen the leadership in the supervision and administration of the scrap vehicle collection and organize the relevant departments to take lawful measures to prevent and investigate the acts in violation of the provisions of the Measures in accordance with the law.
Article 6 The State implements the special industry management on the scrap vehicle collection industry and establishes the system for qualification certificate of the scrap vehicle collection enterprises.
No entities or individuals shall be allowed to engage in the scrap vehicle collection activities except for those obtaining the qualification certificate of the scrap vehicle collection enterprises.
Any entity or individual has the right to report any enterprise engaging in the scrap vehicle collection activities, which are not qualified to or fail to obtain the qualification certification of the scrap vehicle collection enterprises.
Article 7 A scrap vehicle collection enterprise shall, in addition to the requirements for establishing an enterprise in accordance with the provisions of the relevant laws and administrative regulations, satisfy the following requirements:
