Chapter I General Provisions
Article 1 The Measures of the Customs of the People's Republic of China for the Supervision and Administration of Luggage and Articles of Inbound and Outbound Travelers (hereinafter referred to as the "Measures") are formulated in accordance with the Customs Law of the People's Republic of China.
Article 2 The inbound and outbound travelers' luggage and articles shall be subject to entry and exit at a place where there is a Customs office.
Article 3 The inbound and outbound travelers shall deliver all their luggage and articles to the Customs for inspection. Before the delivery for inspection, they shall fill in the Declaration Form for Travelers' Luggage or other declaration documentations as specified by the Customs for declaration; or, in accordance with the declaration means as specified by the Customs, conduct a truthful declaration to the Customs.
Where travelers enter and exit through the Customs implementing the "Red and Green Channels" inspection and release system, they shall select one channel to go through the entry or exit formalities for luggage and articles in accordance with the provisions on selecting the "Red and Green Channels" promulgated by the Customs.
Article 4 The time and place for inspecting the inbound and outbound travelers' luggage and articles shall be designated by the Customs. When the Customs inspects the luggage and articles, the owners of the articles shall be present and responsible for moving the articles, unpacking and resealing the packages of articles. A separate inspection shall be carried out when the Customs considers necessary. No one shall, at will, open or damage the seals affixed by the Customs on the imported and exported luggage and articles.
Article 5 The inbound and outbound travelers may go through the formalities for declaration and tax payment in person or by agent; an agent accepting the entrustment to go through the formalities for declaration and tax payment shall, in accordance with the various provisions as specified in the Measures on its client, handle the customs procedures and undertake various obligations and responsibilities.
Article 6 A traveler shall carry luggage and articles in a quantity not exceeding the reasonable limit for self-use, and no import or export shall be permitted for the luggage and articles in a quantity exceeding the reasonable limit for self-use.
The travelers' luggage and articles shall, upon the examination and approval of the Customs, be inspected and released according to the scope as specified in the Classification Schedule of Luggage and Articles of Inbound and Outbound Travelers (hereinafter referred to as the "Classification Schedule") of the Appendix to the Measures. The provisions on the reasonable quantities for imported and exported articles, and the specific limited values and limited quantities as well as the tax collection, reduction or exemption for the imported and exported articles of various travelers shall be otherwise formulated. Article 7 Where, when entering and exiting, a traveler carries any articles listed in the List of Articles Prohibited for Import and Export of the People's Republic of China and takes an initiative to report them before the Custom's inspection, the Customs shall confiscate or order the traveler to return the articles, and a fine may be imposed on him/her as appropriate. Where the traveler conceals the articles and fail to report to the Customs, he/she shall be subject to the punishments as specified in the Articles 47 and 48 of the Customs Law of the People's Republic of China.
Where, when entering and exiting, a traveler carries any articles listed in the List of Articles Restricted for Import and Export of the People's Republic of China or under the special administration and control of the Government of the People's Republic of China, the Customs shall handle such case in accordance with the relevant laws and regulations of the State.
