Measures for the Final Inspection and Approval of Completed Port Projects

The Measures for the Final Inspection and Approval of Completed Port Projects, which were adopted at the 6th executive meeting of the Ministry of Communications on March 21 2005, are hereby promulgated and shall come into effect as of June 1, 2005.

Measures for the Final Inspection and Approval of Completed Port Projects

Article 1 With a view to standardizing the of the completed port projects, ensuring the quality of port projects, and safeguarding people's lives and property, these Measures are hereby formulated pursuant to the Port Law of the People's Republic of China.

Article 2 These Measures are applicable to final inspection and approval of newly-constructed and reconstructed port projects.
The final inspection and approval of the completed port projects herein refers to a comprehensive inspection and final inspection and approval of the quality of port projects, the implementation of both national and industrial mandatory standards, the use of investment and other matters during the period from the complement of the port projects to the port's putting into service, and the comprehensive appraisal of the designing, engineering, construction and supervision on the port projects.

Article 3 A completed port project may not be put into service until it is accepted as qualified.

Article 4 Principles of openness, impartiality, truthfulness and scientificity shall be followed in the final inspection and approval of the complete port projects.

Article 5 The legal person of the port project and the entities responsible for the designing, construction and supervision of the said project shall be subject to and cooperate with the final inspection and approval of the project aforesaid, and relevant documents provided thereby shall be authentic and effective.

Article 6 The final inspection and approval of the completed port projects shall be operated with unified management and with each level assuming responsibility for its own work.
The Ministry of Communications shall be in charge of the unified management of the final inspection and approval of the completed port projects nationwide.
The Ministry of Communications shall be responsible for the final inspection and approval of the completed port projects examined and approved by the investment competent authorities of the State Council and examined by the Ministry of Communications.
The provincial competent authorities of communications shall be responsible for the final inspection and approval of port projects which examined and approved by the provincial people's government and examined by the provincial competent authorities of communications.
The port projects other than those as prescribed in Paragraphs 3 and 4 of this Article shall be subject to the final inspection and approval of the ports administrative department where the port is located.
