The Measures for the Supervision over the Fair Opening of Oil and Gas Pipeline Facilities (for Trial Implementation) are hereby issued to you for your implementation in compliance. Should there be any problem in the implementation, please report it to the National Energy Administration timely.
Measures for the Supervision over the Fair Opening of Oil and Gas Pipeline Facilities (for Trial Implementation)
Article 1 In order to promote the fair opening of oil and gas pipeline facilities, improve the utilization efficiency of oil and gas pipeline facilities, ensure the safe and stable supply of oil and gas, standardize the market behaviors concerning the opening of oil and gas pipeline facilities, and establish the fair, equitable and orderly market order, the Measures for the Supervision over the Fair Opening of Oil and Gas Pipeline Facilities (for Trial Implementation) (hereinafter referred to as the "Measures") are hereby formulated.
Article 2 The Measures apply to the supervision over the opening of oil and gas pipeline facilities within the territory of the People's Republic of China and the sea areas under the jurisdiction of the People's Republic of China.
Article 3 For the purpose of the Measures, the oil and gas pipeline facilities refer to the main lines and branch lines of crude oil, refined oil and natural gas pipelines (including the oil and gas pipelines undertaking transport functions within the provinces) and relevant supporting facilities for the pipelines (including docks, loading and offloading facilities, LNG receiving stations, liquefaction facilities of natural gas and natural gas compressors, and oil and gas storage facilities) in compliance with the corresponding technical conditions and specifications, for which the examination and approval, ratification or filing procedures are completed in accordance with the relevant provisions of the State and local regions. The provisions of the relevant laws and regulations shall be implemented with respect to the urban gas facilities.
For the purpose of the Measures, the opening of oil and gas pipeline facilities refer to the opening of oil and gas pipeline facilities for use in relevant services, such as the transport, storage, gasification, liquefaction and compression, by and among the operating enterprises of the oil and gas pipeline facilities or the opening of the same by such enterprises to their upstream users and downstream users.
For the purpose of the Measures, operating enterprises of oil and gas pipeline facilities refer to the enterprises registered within the territory of the People's Republic of China, which are exclusively or partially engaged in oil and gas pipeline facilities business.
For the purpose of the Measures, upstream users refer to the oil and gas production enterprises and upstream oil and gas sales enterprises registered within the territory of the People's Republic of China and satisfying the laws and regulations of the State and the relevant industry policies.
