Notice on Effectively Administering the Filing Process for Branded Car Distributors

To the administrations for industry and commerce in all provinces, autonomous regions, municipalities and separately planned cities:

Further improve the filing process for branded car distributors, resolve the problems encountered in the course of administering the process, clarify the details of and procedures for the verification of the information filed and effectively regulate the car market, the details of this Notice are hereby announced as follows:

Article 1 Filing Process for Commercial Car and Over Nine-Seat Passenger Car Enterprises
According to Article 36 of the "Car Industry Development Policy" as approved by the State Council, which provides that "car distributors shall committee their car trading activities within the business scope as approved by the administrations for industry and commerce. The business scope of distributors trading in brands of cars less than nine seats (including second-hand cars) shall be approved and announced by the administrations for industry and commerce in reliance on the relevant provisions", enterprises trading in brands commercial cars and cars more than nine seats do not fall within the scope of the filing requirement. The local authorities shall strengthen their supervision and provide guidance to the development of distributors' brands.

Article 2 Rights of Trading in Small Branded Cars Conferred by the Former State Administration for Industry and Commerce and Former State Planning Commission before the Operation of the "Measures on Implementing the Administration of Sale of Car Brands"
Before the "Measures on Implementing the Administration of Sale of Car Brands" came into operation, 20 car suppliers had already authorized their distributors in brand trading mode.
