Decision of the Ministry of Construction on Amending the Measures for Administration of Advance Sale of Urban Commodity Houses (2004)

The Decision of the Ministry of Construction on Amending the Measures for Administration of Advance Sale of Urban Commodity Houses discussed and adopted at the 41st executive meeting of the Ministry of Construction on July 13, 2004, is hereby promulgated, and shall come into force from the date of promulgation.

Attached: Decision of the Ministry of Construction on Amending the Measures for Administration of Advance Sale of Urban Commodity Houses

It was decided by the Ministry of Construction to amend the Measures for Administration of Advance Sale of Urban Commodity Houses (Order of the Ministry of Construction No. 95) as follow:

I. The phrase "the city or county people's government" in Paragraph 3 of Article 4 was amended as "the municipal or county people's government".

II. Article 6 was amended as: "The permission system shall be adopted for the advance sale of commodity houses. In case a development enterprise sells commodity houses in advance, it shall apply to the real estate administrative department for the permission for advance sale, and obtain the Permit for Advance Sale of Commodity Houses.
No development enterprise may sell commodity houses in advance without obtaining the Permit for Advance Sale of Commodity Houses.

III. Article 7 was amended as: "When the development enterprise apply for the permit for advance sale, it shall submit the following certificates (copies) and materials:
