Measures for the Random Inspection of the Quality of Goods in the Realm of Circulation

The State Administration for Industry and Commerce has, upon deliberation in a working meeting, adopted the
Measures for the Random Inspection of the Quality of Goods in the Realm of Circulation which is hereby promulgated and shall take effect on March 15, 2014.

Measures for the Random Inspection of the Quality of Goods in the Realm of Circulation

Chapter I General Provisions

Article 1 In order to strengthen the supervision and administration of the quality of goods in circulation and protect the legitimate rights and interests of consumers, these Measures are formulated according to the Law of the People's Republic of China on the Protection of Consumer Rights and Interests, the Product Quality Law of the People's Republic of China, other relevant laws and regulations, and relevant provisions issued by the State Council.

Article 2 For the purpose of these Measures, random inspection of the quality of goods in the realm of circulation (hereinafter referred to as "Random Inspection") shall refer to the supervision and inspection activities whereby administrations for industry and commerce, pursuant to the law and according to their responsibilities, conduct Random Inspections of the quality of the goods in circulation and deal with relevant situations accordingly.

Article 3 Administrations for industry and commerce shall, according to relevant laws and regulations, provisions issued by the State Council and these Measures, conduct Random Inspections of the quality of goods at regular or ad hoc intervals.
The State Administration for Industry and Commerce ("SAIC") is responsible for providing guidance on the Random Inspection of the quality of goods in circulation at the national level, and shall carry out, or organize administrations for industry and commerce of all provinces, autonomous regions and municipalities directly under the Central Government to carry out, Random Inspection of the quality of goods in circulation.
Administrations for industry and commerce of all provinces, autonomous regions and municipalities directly under the Central Government (hereinafter referred to as the "Provincial Administration for Industry and Commerce") are responsible for the coordinated planning, management and organization of the Random Inspections of the quality of goods in circulation within their respective regions.
Administrations for industry and commerce below the provincial level shall carry out Random Inspections of the quality of goods in circulation and all related activities in accordance with the provisions issued by Provincial Administrations for Industry and Commerce.

Article 4 During Random Inspections, the quality of goods shall be judged in accordance with relevant laws and regulations, mandatory standards and other relevant provisions, relevant product standards indicated on the goods themselves or their packaging, or the quality conditions indicated by product brochures, physical samples or in other forms.
