Regulations for the Administration on Developing, Utilizing and Protecting Urban Groundwater

Article 1 With a view of strengthening the administration on developing, utilizing and protecting urban groundwater, ensuring urban water supply, controlling the subsidence of ground, protecting urban economic and social development, in accordance with the Water Law of the People's Republic of China, the Urban Planning Law of the People's Republic of China, the Regulations for the Administration on Urban Saving on Water and the Measures for the Implementation of the Water-drafting License System, the Regulations for the Administration on Developing, Utilizing and Protecting Urban Groundwater(hereinafter referred to as the "Regulations") is hereby formulated.
Article 2 The "urban groundwater" used in the Regulations refer to the groundwater resources within urban planning areas.
The "urban" used in the Regulations refers to of the municipalities directly under the central government, cities and towns established by the state in accordance with the administrative organizational structure system.
The "urban planning areas" used in the Regulations refer to urban districts, suburbs and the areas within urban administrative areas that are under the planning control out of the needs of urban construction and development.
Entities and individuals engaging in development, utilization and protection of urban groundwater shall comply with the Regulations.
Article 3 Administration on urban groundwater shall implement the guideline of overall planning, reasonable development, scientific utilization and strict protection and shall insist on the principle of balancing drafting and supplementing.
Article 4 The administrative authority of construction of the State Council shall take charge of the administration on nationwide development, utilization and protection of urban groundwater.
The urban administrative authorities of construction of local people's governments at the county level or above shall take charge of the administration on development, utilization and protection of urban groundwater within their respective administrative areas.
Article 5 The administrative authorities of construction shall commend or reward the entities and individuals that have made outstanding achievements in the administration on urban groundwater.
Article 6 Urban administrative authorities of construction shall, together with relevant authorities, organize well the exploration and assessment of the quality and stream of urban groundwater, establish the managerial system and monitoring networks of urban groundwater, grasp the change in the water level and water quality of groundwater, and provide the bases for development, utilization and protection of urban groundwater.
Article 7 Urban administrative authorities of construction shall formulate the plans of development, utilization and protection of urban groundwater in accordance with drainage areas or comprehensive plans of regional water resources.
Article 8 Urban administrative authorities of construction shall take charge of formulating the development and utilization plans of urban groundwater and the annual water-using plans and organize the implementation thereof, and shall be consonant with the long-term water supply and demand plan approved by the administrative authorities of plans of the people's governments at the same level.
