We have received from your bureau the Urgent Query on Whether the Administration for Industry and Commerce of Fujian Province is Entitled to the Power of Administrative Punishments against the Foreign-invested Enterprises (Min Gong Shang Wai Qi Zi [1999] No. 44).After our discussion in this regard, we hereby reply to your request as follows:

I. In accordance with the principle "this regulation is applicable to the foreign-invested limited liability company, unless otherwise provided in the laws and administrative regulations with respect to foreign-invested enterprises" prescribed in Article 75 of Administrative Regulations of the People's Republic of China on Company Registration.
