Tentative Provisions on the Management of Year-End Budget Surplus Funds in the Experiment of the State Treasury Management System Reform

In order to further strengthen and perfect the use and management of the year-end budget surplus funds in the experiment of the state treasury management system reform, we revised the relevant provisions for such management and re-enacted the Tentative Provisions on the Management of Year-end Budget Surplus Funds in the Experiment of the State Treasury Management System Reform. We hereby promulgate these Provisions for your observance.
During the implementation of these new Provisions, as a general rule, we will stop the appropriation of funds directly from the state treasury for year 2003 as from December 25, 2003, due to the revision and updating of the centralized payment information system of the state treasury. All units involved in the experiment shall submit to us (the Verification Office of the State Treasury Payment Center) the unpaid funds in the budget directly appropriated from the state treasury announced before December 25, 2003, divided according to the grass-roots budget units and classified on the class, sub-class, item and entry of the budgetary account (by the Software Centralized Payment of State Treasury for Central Departments 4.0 Version and in the format of the Supplementary Budget for the 4th Quarter of Year 2003), and we will resume to appropriate the funds directly from the state treasury on January 5, 2004. The normal rules will be implemented in the subsequent years.

Article 1 In order to regulate the use and management of the year-end budget surplus funds in the experiment of the state treasury management system reform, we hereby enact these Provisions in accordance with the Measures for the Management of Appropriation of Funds in the Experiment of the State treasury Management System Reform for Central Units (Cai Ku [2002] No.28), the Tentative Measures for Accounting in the Experiment of the State Treasury Management System Reform (Cai Ku [2001] No.54) and the Supplementary Tentative Provisions for the Accounting System of the General Fiscal Budget (Cai Ku [2001] No.63).

Article 2 The year-end budget surplus funds in the experiment of the state treasury management system reform (hereinafter referred to as Surplus Funds) shall mean those funds for a specific year have not been used by a budgetary unit involved in the experiment of reform (hereinafter referred to as Budgetary Unit) within a budgetary year according to the departmental budget approved by the Ministry of Finance and so shall be retained by the same budgetary unit for use according to the relevant provisions of the fiscal system. The surplus funds include the surplus funds of administrative departments and public institutions, surplus funds for governmental procurement, surplus funds in the project funds retained by the budget unit, surplus funds in the packaged cost of completion and investment of basic construction projects, as well as other surplus funds as specified in the rules and regulations of the fiscal system.

Article 3 The amount of budgetary unit's surplus funds shall be calculated according to the amount of the departmental budget approved by the Ministry of Finance plus the surplus funds in the budget of the previous year minus the amount paid from the state treasury in the year minus the amount to be returned to the State Treasury, and shall be verified and approved by the Ministry of Finance according to the prescribed procedures.
