Decision of the Ministry of Construction on Amending the Measures for the Management of Advance Sale of Urban Commercial Houses passed the forty fifth executive meeting's consideration on July 23, 2001. The present Decision shall be implemented as of the day it is released.

Decision of the Ministry of Construction on Amending the Measures for the Management of Advance Sale of Urban Commercial Houses is as follows:
I. The Article 1 was modified as: "For the purposes of strengthening the management of advance sale of commercial houses and protecting the legitimate rights and interests of both parties in the dealings of commercial houses, the present Measures are formulated in accordance with the Law of the People's Republic of China on the Administration of the Urban Real Estate and the Administrative Regulations on Urban Real Estate Development and Operation".
II. Clause 2 of Article 5 was modified as: "2. Having a construction project planning license and a construction license".
III. The Article 7 was modified as: "When a real estate development enterprise applies for advance sale approval, it shall submit the following certificates (copies) and materials:
1. Evidentiary material stated in Clause 1 to 3 of Article 5;
2. The Business License and qualification certificate of the real estate development enterprise;
3. Engineering construction contract;
4.The plan on advance sale of commercial houses. It shall state the location, fitting standard, completion delivery date and realty management of the commercial houses to be sold in advance, accompanied by the ichnographies based on the floors of the commercial houses to be sold in advance.
