Provisions on the Administration of Urban Real Estate Intermediary Services (Revised in 2001)

Chapter I General Provisions
 
Article 1 In order to strengthen the administration of the urban real estate intermediary services, to maintain the order of the real estate market, and to guarantee the lawful rights and interests of the parties to the real estate activities, these Provisions have been formulated according to the Law of the People's Republic of China on the Administration of Urban Real Estate.
 
Article 2 Whoever engaged in the urban real estate intermediary services shall observe these Provisions.
The term "real estate intermediary services" used in these Provisions is the general term of the activities including real estate consultation, real estate price evaluation, and real estate broker, etc.
The term "real estate consultation" used in these Provisions refers to the operations of offering services to the parties to the real estate activities in such aspects as laws and regulations, policies, information, and technologies, etc.
The term "real estate price evaluation" used in these Provisions refers to the business operations of measuring and calculating real estates, evaluating the economic value and agency business thereof.
The term "real estate broker" used in these Provisions refers to the business operations of providing real estate information and brokerage service to the trustees.
 
Article 3 The administrative department in charge of construction under the State Council shall be responsible for the centralized administration of the real estate intermediary services of the whole country
The administrative departments in charge of construction of the provinces and autonomous regions shall be responsible for the centralized administration of the real estate intermediary services within their respective administrative areas.
The administrative departments in charge of construction of the people's governments of the municipalities directly under the Central Government, cities, and counties (hereinafter referred to as the departments of real estate administration) shall be responsible for the administration of the real estate intermediary services within their respect administrative areas.

Chapter 2 Administration of the Qualifications of Intermediary Services Personnel
 
Article 4 The personnel engaged in the real estate consultation shall be the professional technical personnel who have the educational background of the middle level or above degree of real estate or relevant trades, and have the professional technical title of the primary level or above relating to the trade of real estate consultation and have obtained the certificates for passing the examinations.
The measures for the examinations for personnel of real estate consultation shall be formulated by the administrative departments of the people's governments of the provinces and the autonomous regions in charge of construction and the departments in charge of real estate administration of the municipalities directly under the Central Government.
 
Article 5 The State applies the qualification authentication system for the personnel of real estate price evaluation.
The personnel of real estate price evaluation are classified as the master valuator of real estate and the valuator of real estate.
 
Article 6 The master valuator of real estates shall be the personnel that have passed the national uniform examination and the authentication of practice qualification, obtained the Certificate of Practice Qualification of Master valuator of real estates, and obtained the Certificate of Registration of Master valuator of real estates through registration.
