Decision of the State Council on the Revision of the Regulations of the People's Republic of China on Safeguard Measures

The Decision of the State Council on the Revision of the Regulations of the People's Republic of China on Safeguard Measures is hereby promulgated and shall come into effect as of June 1, 2004.

The State Council has decided to make the following amendments to the Regulations of the People's Republic of China on Safeguard Measures:
　
Article 1 The term "The Ministry of Foreign Trade and Economic Cooperation (MOFTEC)" as mentioned in Articles 3, 4, 5, 9, 14, 18, 21, 22, 25, 30 and 35 shall be amended to "Ministry of Commerce (MOFCOM)."
　
Article 2 The text Article 6 shall be amended to "The investigation and determination of damage shall be made by the MOFCOM, and the investigation of the damage of agricultural products for taking safeguard measures shall be made by the MOFCOM jointly with the Ministry of Agriculture."
　
Article 3 The terms "The MOFTEC and the STEC" as mentioned in Articles 11, 12, 13, 29 and 34 shall be amended to "the MOFCOM."
　
Article 4 The text "the increase of the quantity of imported products shall refer to the absolute increase or relative increase of the quantity of imported products as compared with the home production" as used in Article 7 shall be amended to "the increase of the quantity of imported products shall refer to the absolute increase of the quantity of imported products or the relative increase as compared with home production."
　
Article 5 Articles 15 and 16 shall be unified as a single Article 15 and shall read as follows: "On the basis of the investigation result, the MOFCOM may make an initial award or directly make a final award, and make an announcement."
　
Article 6 Article 20 shall be amended to Article 19.
