Decision of the State Council on the Revision of the Regulations of the People's Republic of China Concerning Export Controls on Dual-purpose Nuclear Products and Relevant Technologies

The Decision of the State Council on the Revision of the Regulations of the People's Republic of China Concerning Export Controls on Dual-purpose Nuclear Products and Relevant Technologies is hereby issued, and shall come into effect as of the date of promulgation.

The State Council has determined to make the following amendments to the Regulations of the People's Republic of China Concerning Export Controls on Dual-purpose Nuclear Products and Relevant Technologies:
Article 1. Article 1 shall be revised as follows: "These Regulations are formulated in order to reinforce export controls on dual-purpose nuclear products and relevant technologies, prevent the diffusion of nuclear weapons, combat acts of nuclear terrorism, promote international cooperation in the peaceful utilization of nuclear energy, and safeguard national security and social public benefits."
Article 2. Article 2 shall be revised as follows: "The export of dual-purpose nuclear products and relevant technologies" as referred to in these Regulations means the transfer of equipment, materials, software and relevant technologies included in the List of Export Controlled Dual-purpose Nuclear Products and Relevant Technologies (hereinafter referred to as the Control List) in terms of export trade, endowments to and exhibitions in foreign countries or regions, as well as scientific and technological cooperation with and assistance and services, etc. to foreign countries or regions."
Article 3. Article 3 shall be revised as follows: "The state shall strictly control the export of dual-purpose nuclear products and relevant technologies, rigorously perform its international obligations to prevent the diffusion of nuclear weapons, and prevent dual-purpose nuclear products or relevant technologies from being used for the purpose of nuclear detonation or for nuclear terrorism activities.
The state may take any necessary measure related to the export of dual-purpose nuclear products and relevant technologies in order to maintain national security as well as international peace and safety."
